<br />access easements over the portion of the street which is <br />located within this development. <br /> <br />36. The applicant shall dedicate, upon demand, to the City for <br />street right-of-way purposes across the full frontage of the <br />site sufficient area to accommodate a 4 lane Foothill Road <br />with median island as described in the General Plan. This <br />right-of-way shall be based on the 1990 Foothill Road <br />Alignment study, and shall include all necessary easements for <br />slope banks. This dedication shall take the form of an "Open <br />Offer of Dedication". The applicant shall enter into an <br />agreement for this dedication that shall be recorded with the <br />deed for the property within one month of the approval of this <br />PUD. This area of land to be offered for dedication to the <br />City shall be included in the adjacent open space parcel and <br />shall remain a part of that parcel until such time that the <br />City accepts such offer of dedication. <br /> <br />37. The applicant shall contribute the cost for interim street <br />improvements for the western half of Foothill Road, per the <br />1990 Foothill Road Alignment study, across the full project <br />frontage of the project site and the necessary transitions on <br />both the north and south ends. The applicant shall enter into <br />an agreement and post sufficient security, as approved by the <br />city Attorney and City Engineer, to pay this cost that shall <br />be recorded with the deed for the property within one month of <br />the approval of this PUD. <br /> <br />38. The developer shall construct the private street across the <br />northern property (Parcel A of PM 5423, currently owned by the <br />applicant) to the terminus of the private street on the <br />eastern property line of the Hempy property (PUD 88-16). In <br />the event that the private street is not constructed across <br />the Moller and Hempy properties prior to the approval of the <br />minor subdivision for this project, the applicant shall <br />negotiate in good faith with the property owners to acquire <br />sufficient land to construct the access road from the project <br />site to Foothill Road/Muirwood Drive North intersection, as <br />shown on the development plan. Should the developer be unable <br />to acquire said land, the applicant shall submit a new <br />development plan for this project site to the City for review <br />and approval. Evidence of the access easements for the entire <br />private roadway and the establishment of the roadway <br />maintenance agreement and entity shall be submitted for the <br />review and approval by the City Attorney prior to the <br />recordation of the parcel map. No new building permits will <br />be issued for this development until such time as the roadway <br />improvements are constructed. <br /> <br />39. Access to Lot 3 shall be maintained at all times during <br />construction. The applicant shall submit a plan to the City <br />showing how access will be maintained during construction of <br />the main road for City review and approval prior to the <br />issuance of a grading permit. <br />
