such as fencing, dense landscaping, etc. , shall be
incorporated in the plans in such a manner to ensure that the
house and yard areas would not have an adverse impact on the
privacy in the usable yard area of the adjacent lot to the
south.

18. The proposed custom homes to be located on Lots 1 and 2 shall
only face Foothill Road.

GRADING

19. The developer shall submit a final grading plan for the site
to the Planning Director and city Engineer for review and
approval prior to the recordation of the Parcel Map of the
site. The grading plan shall include the proposed finished
grading of the site after the removal of the debris, and any
revisions to the grading of the proposed private street. The
objective of this grading plan shall be to emulate, to the
greatest extent possible, the natural grades of the site which
existed prior to the placement of the fill and debris.

20. The finished grade of all areas of the lot except within the
120 foot setback from Foothill Road shall not be cut or filled
more than five feet from the finished grade shown on the final
map, except in the area beneath the main structure where the
grade may be cut more than five feet. The grade of the area
within the 120 foot setback from Foothill Road may not be
substantially changed and shall remain as shown on the final
subdivision grading plan. The grading on these lots shall be
sUbject to the review and approval of the Design Review Board
at the time of the review of the custom homes to be
constructed on each lot.

21. The grading plan for the proposed custom homes on Lots 1 and
2 shall not utilize a flat building pad, but, rather, a split-
pad configuration shall be used with the objective of limiting
grading to the maximum extent.

22. The applicant shall immediately notify the Planning Director
of any changes to the approved grading of the site which may
result during the excavation of the debris from the site.
Prior to the completion of the site grading, the applicant
shall notify the Planning Director of any anticipated
deviations of the site grading from the approved grading
plans. An "as-built" topographical survey, certified by a
licensed surveyor, of the entire three-lot site shall be
provided to the Planning Director prior to the approval of the
custom home designs by the Design Review Board.

23. All areas depicted on the final grading plan as being "grade
to daylight" shall be rounded and not left with any abrupt cut
or fill.
