The developer shall enter into an agreement with the city <br />to enter into an assessment district or districts for the <br />construction of all the facilities necessary for the <br />amelioration of traffic congestion in the north <br />pleasanton/foothill road corridor, of which it is a part. <br />The developer shall enter into this agreement prior to <br />the final map. This agreement shall require that no <br />protest be made to the inclusion in or establishment of <br />assessment districts or other funding mechanisms which <br />place the developer or each lot owners' pro rata share of <br />the cost of the public improvements to be built pursuant <br />to the formation of the assessment district. This <br />agreement shall be recorded with the final map. <br /> <br />e. Prior to tentative map approval, the developer shall <br />conduct a needs assessment in conjunction with Livermore <br />Amador Valley Transit Authority for a bus turn out along <br />the Foothill Road frontage. The specific results and <br />recommendations shall be presented to the Planning <br />commission in conjunction with any tentative map. <br /> <br />28. Noise <br /> <br />a. All site improvement activities shall be limited to the <br />hours of 8:00 a.m. to 5:00 p.m. Monday through Saturday. <br />All construction equipment shall meet DMV noise standards <br />and shall be equipped with mUffling devices. When <br />necessary, shielding material shall be used for unusually <br />high noise generation sources. <br /> <br />b. A grading plan shall be submitted to an acoustical <br />engineer to verify that the assumptions contained within <br />the earlier noise study are valid and that exterior noise <br />levels do not exceed 60 dB and that interior noise levels <br />do not exceed 45 dB for any lots. If noise levels are <br />predicted to exceed these standards mitigation measures <br />shall be implemented. Exterior noise reduction measures <br />may include berming, fencing, or use of building mass. <br />Interior noise reduction measures may include limiting <br />the houses on these lots to one story, orienting sleeping <br />areas furthest from the freeway, the use of a mechanical <br />ventilation system with a closed window condition, <br />dOUble-paned windows, insulation, or seals/stripping. <br />The acoustical review, with any mitigation, shall be <br />prepared for the review and approval of the Planning <br />Director prior to final map approval. <br /> <br />Resolution No. PC-91-9 <br />February 27, 1991 <br />
