<br />7. A minimum of 102 trees shall be installed on-site. At least <br />15 percent of the trees on-site sha11 be of 24 inch box size <br />or larger. The location and type shall be subject to review <br />and approval by the Planning Director prior to final map <br />approval. <br /> <br />8. A homeowner's association shall be established for the subject <br />property. The CC&R's for the association shall incorporate <br />the following conditions: <br /> <br />a. Long term parking is prohibited in the driveways of the <br />units. Except for overnight loading and unloading from <br />trips, no overnight parking is allowed. Boats and <br />recreational vehicles shall not be parked on site. <br /> <br />b. The 10 parking spaces located throughout the development <br />shall be reserved for guests. No overnight parking by <br />occupants shall be allowed. <br /> <br />c. All trees located within the rear yard areas shall be <br />maintained in good health and vigor at all times. <br /> <br />d. The garage parking spaces shall not be used for long term <br />storage, in excess of 72 hours, and shall be maintained <br />unobstructed and available for parking of vehicles. <br /> <br />9. That the developer shall establish a homeowners association <br />through the CC&R's for the project. The association shall be <br />responsible for maintaining all common open space, private <br />utilities, private streets, project walls, and other common <br />areas and improvements within the development. The city shall <br />be granted the rights and remedies of the association, but not <br />the obligation, to enforce the maintenance obligations. The <br />City Attorney shall review and approve the proposed CC&R's <br />prior to the recordation of a final subdivision map for the <br />project. <br /> <br />10. The homeowner's association for the project shall be <br />responsible for the maintenance of the landscape area along <br />the property's frontage, up to the back of sidewalk along <br />Santa Rita Road. <br /> <br />11. The proposed soundwall in terms of design, color and material <br />shall match the existing soundwall to the north. Specific <br />details including final location, design, landscape berming, <br />and materials shall be submitted for review and approval by <br />the Planning Director prior to issuance of building permits. <br />In general, the location shall follow the recommendation of <br />the acoustical report prepared by Charles M. Salter & <br />Associates dated January 25, 1991. <br /> <br />- <br />
