That the developer shall install the landscaping in the 24- <br />foot wide landscape buffer area, to the satisfaction of the <br />Planning Director, and prior to the issuance of building <br />permits for the Phase 1 homes, un1ess said time is modified by <br />the Planning Director. The County of Alameda, or subsequent <br />property-owner(s), shall give the developer right of access to <br />install said landscaping. <br /> <br />11. That the County of Alameda, or subsequent property-owner of <br />the eastern portions of Staples Ranch, shall bear full and <br />sole responsibility for maintaining the landscape buffer area <br />in a healthy, weed-free and fire-safe manner to the <br />satisfaction of the city. The County, or subsequent property- <br />owner of the eastern portions of staples Ranch, shall maintain <br />the buffer area until such time as the remainder of the <br />Staples Ranch property to the east of this site is developed, <br />and the landscaping and automatic irrigation system is <br />installed for this landscape buffer area. <br /> <br />Pr ior to the approval of the Final Map, the County, or <br />subsequent property-owner of the eastern portions of Staples <br />Ranch, shall enter into a maintenance agreement with the City. <br />Said agreement shall hold the County liable for maintaining <br />the landscape buffer area in a manner defined in the <br />agreement. If the area is not maintained to the satisfaction <br />of the City, due to negligence on the part of the County, the <br />city shall have the right to enter onto the property and <br />conduct the necessary maintenance, and the City shall have the <br />right to levy fees for said maintenance. <br /> <br />12. The noise study for the soundwall shall be completed by the <br />County and submitted for review and approval of the Planning <br />Director, prior to approval of the Final Map. The design, <br />location and height of the soundwall and the level of noise <br />reduction achieved by the soundwall shall be identified. The <br />soundwall shall achieve, at the very least, a reduction in <br />noise levels in the rear yards to 67 dBA Leq at the noisiest <br />hour. <br /> <br />13. All public infrastructure improvements and installation of <br />utilities underground shall occur in conjunction with the <br />phasing plan as delineated on the Tentative Map. <br /> <br />14. Phase 1 shall include the lots and streets as shown, and shall <br />include the improvements required for the 2.7 acre parcel to <br />be dedicated for Meadow Park. The construction of the <br />soundwall and the installation of the plan materials in the 24 <br />foot wide landscape buffer shall be included in Phase 1 <br />improvements. <br /> <br />- <br /> <br />- <br />
