She stated she has no <br />objections to the design of the project; only to it being a rental. <br /> <br />Commissioner Michelotti explained that the applicant is within his rights under State law to <br />apply for and be granted this conditional use permit and that the City cannot overrule that <br />law, whether the unit be in Golden Eagle or another neighborhood within the City of <br />Pleasanton. Commissioner Hovingh added that State law requires that a conditional use <br />permit be granted for a secondary unit if the unit meets the State law requirements; State law <br />also says the unit shall not be intended for sale and may be rented. It does not state that it <br />must be rented to a family member. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />Commissioner Horan observed that the fire department would probably require a separate <br />address for a secondary unit; the Post Office would simply treat it as two families or people <br />with different names. He noted that he did not particularly favor a second address. <br /> <br />Chairman Mahem raised the issue of a fire in the main home, with the possibility that the <br />fire department may not realize there are elderly people in the second unit, should only one <br />address be shown. <br /> <br />~ <br /> <br />In response to Commissioner Michelotti's question, Mr. Rasmussen replied that the second <br />address number could be on the curb. <br /> <br />A motion was made by Commissioner Horan, seconded by Commissioner Wright making the <br />required use permit findings and approving Case UP-91-70 subject to the conditions listed in <br />Exhibit B, with the following modification: <br /> <br />.
