<br />Commissioner Horan asked the applicant if he has considered that the public access staging <br />area might be dedicated to the City. The applicant replied that they have had some informal <br />discussion on the matter, but nothing definite was decided. <br /> <br />In response to Chairman Mahem's question in regard to the removal of Conditions 5 and 6, <br />Mr. Rasmussen replied that Council had indicated its desire for acquiring public access tight <br />to open space areas. Additional time could be allowed in order for Conditions 5 and 6 to be <br />worked out between the developer and the homeowners' association. <br /> <br />Commissioner Hovingh asked staff if the City's goal is to make public accesses the same <br />from project to project. Mr. Rasmussen replied that it is the general policy to try and treat <br />projects equally. They would attempt to make the Bonde project consistent with this one; <br />however, these are issues that yet have to be resolved. Mr. Rasmussen noted that staff could <br />get together with the Association and developer and report back to the Commission. He <br />concluded that the Commission could require that this concept and details could be worked <br />out at a later time. <br /> <br />Further discussion ensued regarding Conditions 5 and 6. <br /> <br />~ <br /> <br />Paul Harbottle, Kottinger Ranch Association Manager, stated that the Kottinger Ranch Board <br />fully supports the application for the time extension for Tract 5721. He indicated that the <br />bulk of their concerns have been taken care of; in addition, the Board feels that the developer <br />is now in a position to fulfill its responsibilities. Mr. Harbottle said the Board is concerned <br />about Conditions 5 and 6 and liability to the Association. Should a claim be filed against the <br />Association, they feel that there might be a problem at renewal time. In regard to the <br />staging area, he said they had not even heard about it until yesterday. He expressed further <br />concern about liability for the Association in that regard. He noted that he is speaking as the <br />Association manager, not as a resident. <br /> <br />Commissioner Horan asked Mr. Harbottle if the Association has ever considered deeding <br />Parcel "A" to the City. Mr. Harbottle said they have had some discussion with Brian Swift <br />on this matter, but no decisions were made. At this time, he could not say whether the <br />Association would be willing to dedicate this land to the City. <br /> <br />The applicant returned to the podium and thanked the Commission for its support. <br /> <br />THE PUBLIC HEARING WAS CWSED. <br /> <br />A motion was made by Commissioner Michelotti, amended at the reques of Chairman <br />Mahem, and seconded by Commissioner Wright approving the time extension on Tract 5721 <br />to December 31, 1992, subject to Conditions 1 through 4 of Exhibit "B", and continuing <br />resolution of Conditions 5 and 6, with staff, applicant and the Kottinger Ranch Homeowners <br /> <br />Minutes Planning Commission <br />December 11, 1991 <br /> <br />Page 12 <br /> <br />- <br /> <br />- <br />
