~ Commissioner McGuirk raised the question of capacity. Mr. Rossi noted that the capacity will be lOO with the expansion, and commented that 80% of their business is after 5 p.m. even though they do serve lunches. THE PUBLIC HEARING WAS CWSED. Commissioner Michelotti commented that the staff report shows this is a well- established business in the City and has never been a problem. She wished to point out that the business has also been very supportive of the Ryan Comer fund, which indicates they are in touch with the community. A motion was made by Commissioner McGuirk, seconded by Commissioner Wright making the conditional use findings and approving Case UP-91-77 subject to the conditions listed in Exhibit B, with the following modification: o That Condition 5 be deleted. Mr. Swift presented the staff report recommending approval of Case UP-91-69 subject to the conditions of the staff report. THE PUBLIC HEARING WAS OPENED. Betsy Chazni, 5860 W. Las Positas Blvd. represented the application. She stated she has read the staff report and concurs with the conditions of approval.
