ROLL CALL VOTE

AYES:

Commissioners Horan, McGuirk, Michelotti, Wright, and Vice Chairman
Hovingh
None
Chairman Mahem
None

NOES:
ABSENT:
ABSTAIN:

Resolution No. PC-91-95 was entered and adopted approving Case UP-91-75 as motioned.

UP-91-77. Sunshine Saloon
Application for a conditional use permit to expand an existing bar and restaurant
facility located at 1807 ilK" Santa Rita Road, in the Valley Plaza Shopping Center.
Zoning for the property is PUD (planned Unit Development) - C District.

Mr. Swift presented the staff report recommending approval of Case UP-91-77, subject to
the conditions of the staff report. He clarified the staff report, noting there will be six pool
tables rather than five; he also recommended that Condition 5 should be deleted because it is
not relevant to the case as it is strictly considered a bar.

Commissioner Wright addressed Condition 3 and discussed with staff the necessity for the
condition as the establishment has not been a problem in the neighborhood, and that the use
permit could be revoked should disturbances take place. Mr. Swift explained that this is
simply a standard condition for a bar. The intent is to keep the applicant aware that it is
important to the City as to what happens outside of the bar in the nearby vicinity.

Commissioner Horan wished to point out that with the expansion the applicant is now subject
to a conditional use permit.

THE PUBLIC HEARING WAS OPENED.

Robert Rossi, 1807 Santa Rita Road, represented the application. In response to
Commissioner Horan's comment, he replied that until tonight he was not aware that he
would now require a conditional use permit.

Commissioner Horan noted that the permit simply puts the applicant in conformance with the
other bars in the City, and should not be a problem for the applicant.

Mr. Rossi stated he has read the staff report and concurs with the conditions of approval.
He also pointed out that the bar is trying to provide activities and entertainment for the
patrons so they are not just buying liquor. He explained they also have dart boards and
comedy nights, along with the pool tables.

Minutes Planning Commission
November 20, 1991

Page 4

.

.
