PhiIlies Cheesesteak
Appeal of the Design Review Board approval of an application to install a satellite dish
on the roof of the building located at 310 Main Street, Suite D. Zoning for the property
is C-C (Central - Commercial) District.

Mr. Iserson presented the staff report recommending approval of Case
Z-91-93 subj ect to the conditions of the staff report.

-

THE PUBLIC HEARING WAS OPENED.

Bill Toomey, 6016 Alisal, owner of Phillies Cheesesteak on Main Street, represented the
application. He stated he is dismayed to find himself again before the Commission. He
indicated he had no new information to present, but felt that he has tried to conform to the
Ordinance guidelines. In installing the satellite dish, he was not sure whether the Ordinance
meant that the dish should be screened from view as one is walking by or driving by on
Main Street. He said that on Main Street by moving 20-30 feet either way, a person cannot
see the dish at all. He felt the dish is virtually invisible from Main Street and a person in a
car must actually stop to see it. The dish is slightly more visible from Abbie Street, but not
obtrusive by any means. He felt that it was not any more obtrusive than other equipment
that is visible on roofs in the downtown area. He noted that it is not as visible as dishes on
the police and fire department or schools. He stated that with the dish they can pick up any
televised event in the country and gave the Raiders game on Sunday as an example. He
noted that because of this particular game, his restaurant business was much better than
normal. He said a smaller dish would not provide as quality a picture.

Mr. Toomey said he is willing to lower the dish 15 inches as recommended by staff, but did
not feel it is necessary. However, he is willing to work with them on the matter.

Minutes Planning Commission Meeting October 23, 1991
Page 7

..

.
