Commissioner Horan asked if the dish was installed before the Design Review Board
reviewed the application. Mr. Toomey affirmed that it was.

Commissioner McGuirk stated that he was on the DRB when the application was reviewed.
The Board's concern was that this application could start a precedent for future businesses
who may wish to do the same thing. He commented that the restaurant dish could not be
compared in importance with the police, fire and school satellite dishes. He concluded that
he could live with the reduction in height, but pointed out that he would not wish to send a
message to other businesses that this type of situation is acceptable.

THE PUBLIC HEARING WAS CLOSED.

Commissioner Michelotti commented that she could not see the dish from Main Street, but
that it was visible from Abbie Street. As a whole, she wished that other dishes were as
unobtrusive. However, she also did not want to convey the impression that this was
something that was very acceptable in the downtown area.

A motion was made by Commissioner McGuirk, seconded by Commissioner Hovingh
approving Case Z-91-93 subject to the conditions listed in the staff report.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Horan, Hovingh, McGuirk, Michelotti, and Chairman Mahern
None
None
None

Resolution No. PC-91-75 was entered and adopted approving Case Z-91-93 as motioned.

PUD-91-2.
