Resolution No. PC-91-66 was entered and adopted recommending approval of Case PUD-85-
l5-2M as motioned.

UP-91-48. Forsher & Guthrie
Application for a conditional use permit to establish a 1364 sq. ft. fast food take-out
restaurant (Pizza Hut) in an existing building located at 927 Main Street. Zoning for
the property is C-C (Central - Commercial) District.

Mr. Iserson presented the staff report recommending approval of Case UP-91-48 subject to
the conditions of the staff report.

Commissioner McGuirk asked for clarification as to where the delivery truck would park and
expressed concern that it might block traffic at certain times of the day. Mr. Iserson said the
truck would park on the east elevation; in addition, deliveries would not be permitted 12:00
from noon to 1:00 pm, Monday through Friday.

Chairman Mahern asked if the Round Table Pizza delivers. Mr. Iserson affirmed that they
have just started making deliveries.

Commissioner Horan asked if the other tenants have been contacted and if any complaints
have been made. Mr. Iserson said all those within 300 ft. have been contacted and no
objections have been registered with the Planning Department.

THE PUBLIC HEARING WAS OPENED.

Joseph Dixon, architect for the project, represented the application.

Commissioner Horan discussed whether the applicant has an agreement with Round Table in
regard to being a take-out establishment. Dan Rooney, real estate manager, said they have a
private agreement between Round Table and the Pizza Hut on this matter.

Chairman Mahern expressed concern that the Amador High School students would be
inclined to pick up a slice of pizza and eat in the parking lot. Mr. Dixon said they will not
be selling pizza by the slice; they will sell a 6" personal pan pizza. Their intent is not to
encourage the high school students to eat in the parking lot.

Chairman Mahern asked about the design of the building. Mr. Dixon stated this issue would
go before the Design Review Board.

Commissioner McGuirk referred to Condition 6 and recommended that a trash container be
placed by each doorway, instead of just one as noted.

Minutes Planning Commission September 25, 1991

Page 10

..

.
