,-

Mr. Dixon referred to Condition 4; he stated that the Pizza Hut is very concerned about its
image and asked if any complaints were registered, whether the Pizza Hut was notified or
whether they must immediately appear at a public hearing. Mr. Iserson said they would
always be notified first with time to correct a situation. A public hearing is a last resort.

Chairman Mahern asked if the Pizza Hut will serve soft drinks. Mr. Dixon said drinks
would only be served in cans.

Commissioner McGuirk asked if any screening of delivery persons would be done. Mr.
Dixon indicated the drivers would be screened, in particular for driver's licenses.

Commissioner Horan expressed concern about paper and litter that would come from the
Pizza Hut, but might be scattered farther away from the establishment. Mr. Dixon said the
Pizza Hut would want to be made aware of that matter so they might attempt to solve the
problem.

Commissioner McGuirk asked the applicant if he had any problem with the conditions
relating to deliveries. Mr. Dixon had no problem with the conditions.

Commissioner Horan was still concerned about possible blockage of the driveway by delivery
trucks and that they would have a difficult time turning into the driveways. Mr. Iserson
stated staff had considered this matter and it should work; in addition, the curbcut on the
driveway will be reconstructed in order to better facilitate the matter.

Chairman Mahern asked if the Pizza Hut will be making any kind of contingency upon sign
approval. Mr. Dixon was not exactly sure, but said the sign approval will be a separate
issue.

THE PUBLIC HEARING WAS CLOSED.

A motion was made by Commissioner Hovingh, seconded by Commissioner Horan making
the findings for Case UP-91-48 and approving Case UP-91-48 subject to the conditions of the
staff report with the following modification:

o That a trash receptacle be placed adjacent to each door of the establishment.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Horan, Hovingh, McGuirk, and Chairman Mahern
None
Commissioners Michelotti and Wright
None

Minutes Planning Commission September 25, 1991

Page 11

,.

.
