<br />felt it might not be appropriate to use the Foothill Road Corridor as guidelines because it <br />may cause more confusion than it would provide direction. <br /> <br />Further discussion ensued as to whether more direction should be given to the Design <br />Review Board to deeply scrutinize these 20 houses or whether they already have the authority <br />to do that. <br /> <br />Commissioner Hovingh recommended that the trees be planted very early on in the permit <br />process. <br /> <br />A motion was made by Commissioner Horan, seconded by Commissioner Hovingh <br />recommending approval of Case PUD-85-15-2M, subject to the conditions of Exhibit A, with <br />the following modifications: <br /> <br />o Modifying Condition 3 that three of the six 36" box trees should be a part of a <br />mutually acceptable plan between the developer and the homeowner as to the <br />developer compensating the homeowner; <br /> <br />o Adding Condition 7 requiring a legal document that defines specifically how <br />the homeowner and the developer will interact as to reforestation should the <br />homeowner have to proceed before the developer does, as to cost, purchasing, <br />and equitable adjustments; <br /> <br />o That the conditions be so modified to be more specific in terms of <br />compensation to the City, such as performance bonds or some type of security; <br />that monies collected be set aside for reforestation; <br /> <br />o That no occupancy be allowed on a lot until reforestation is complete, but that <br />construction can begin before reforestation is completed; (this would mean the <br />reforestation must be entirely completed before occupancy); and <br /> <br />o That Condition 5 be reworded to direct particular attention to reduced height, <br />'FAR, massing of the houses, color, roof/siding materials, grading, and <br />landscaping on the houses in the visible lots. <br /> <br />It was suggested that a letter be sent to the Design Review Board emphasizing that they <br />exercise their authority in this matter. <br /> <br />ROLL CALL VOTE: <br />AYES: Commissioners Horan, Hovingh, McGuirk, and Chairman Mahern <br />NOES: None <br />ABSENT: Commissioners Michelotti and Wright <br />ABSTAIN: None <br /> <br />Minutes Planning Commission September 25, 1991 <br /> <br />Page 9 <br /> <br />,. <br /> <br />. <br />
