,-

sidewalks and soundwall from Muirwood North to Muirwood South, except for the Schaeffer
area.

Mr. Iserson responded to Mr. DeMichael that the development of the sidewalk and
soundwall would be delayed only to the extent that the applicant is not prepared to do the
improvements now because of a possible lack of financing. It would actually help insure that
the improvements would be done. If the applicant does not get the financing to make the
project move forward, the street improvements also do not go forward.

Commissioner Hovingh asked staff if the neighbors call the Fire Department to take care of a
weed situation, whether the applicant is billed for that service. Mr. Iserson thought that
would be the case.

Don Jenkins, 7884 Kentwood Way, agreed with Mr. DeMichael's concerns and also urged
that something be done to keep uninvited people from going to the project site. He noted
that most people go there at night so it is hard to tell what is really going on, or to eliminate
any overnight camping as has happened in the past.

~

Loran Brown, 5050 Lynbrook Court, stated he also agreed with Mr. DeMichael's comments;
in particular, he favored some type of weed abatement protection. In addition, he spoke of
his fence line which does not coincide with his property line. His fence line is anywhere
from four to six feet within his property line. He said he is not really concerned that
pruning of trees was done on his property, but he would like consideration if the fence lines
are explored. He has a four to five foot drop right beyond his fence line. To reduce the
excessive cost of grading, etc, he would be happy to negotiate with Pan-Cal.

David Chou returned to the podium. He responded to the issue of weed abatement and
stated that they will always take care of the weeds.

In response to Commissioner Horan's question, Mr. Chou said if the City feels the weeds are
too high, he would be willing to do anything to correct the situation. As far as the
neighbor's fence is concerned, he will be happy to negotiate with him to work out a solution.
He also addressed the access to the site which will initially open on Foothill Road, as noted
in the Conditions of Approval, stating that eventually this will be closed in lieu of a new
roadway.

Commissioner Wright asked if there will be security fencing during construction with a gate
closing at night. Mr. Chou affirmed there would be such protection. He was also willing to
install the fencing early on, should the neighbors desire it, if they would keep their children
off the property.

THE PUBLIC HEARING WAS CWSED.

~

Minutes Planning co..is.ion
August 28, 1991

Page 13

II

.
