<br />Commissioner Hovingh discussed Condition 2 with Mr. Iserson. He felt that it would be <br />more appropriate to limit light construction work from 8:00 a.m. to 5:00 p.m., rather than to <br />6:00 p.m. Staff had no problem with changing the time. <br /> <br />Commissioner Hovingh asked staff if the project could be required to have a bond <br />mechanism in place to insure that landscaping and other amenities will be provided as the <br />developer agreed to do. He pointed out that developers for Golden Eagle and Canyon <br />Meadows have been remiss in fulfilling their obligations and he felt the City should have <br />some recourse to recompense. Mr. Iserson said bonds are not in place at this time, but <br />language could be added to the conditions that non-compliance of the stipulations could lead <br />to fines. <br /> <br />Discussion ensued as to the value of having a bond mechanism on the project. <br /> <br />Commissioner Horan asked how the Foothill Road Overlay District applies to this project. <br />Mr. Iserson replied that the Foothill Road Overlay District regulations applies only to <br />development on the west side of Foothill Road. This project is on the east side of Foothill <br />Road. <br /> <br />THE PUBLIC In:ARING WAS OPENED. <br /> <br />~ <br /> <br />David Chou with Pan-Cal, 4125 Blackbird Avenue, San Jose, represented the application. <br />He stated he concurs with staff recommendations. <br /> <br />Commissioner Wright asked the applicant if he had any problem with possible addition of a <br />condition that the neighbors within 300 ft. be notified of any change in business hours so <br />they could monitor the situation as to the use of heavy equipment, etc. Mr. Chou indicated <br />he had no problem with that. <br /> <br />Chairman Mahern asked Mr. Chou why heavy equipment was put on the site in the middle <br />of the night as noted in the staff report. The applicant said he had not been aware of this <br />issue, but would check into the matter. <br /> <br />Commissioner Horan recommended that Mr. Chou make Pan-Cal's name and phone number <br />available to the neighbors, so that they might call should problems arise. <br /> <br />Bob DeMichael, 51 Forest Hill Drive, Pleasanton, requested that the Commission consider <br />some type of weed abatement protection be in place for the project. He noted that dry weeds <br />are a major hazard to the surrounding area. He also pointed out that the fence line is very <br />poor or non-existent on the site; that trash is dumped there; and that young teens go there at <br />night. He asked that these situations be addressed. He also wondered with an extension <br />being granted to Pan-Cal, if property improvements would be delayed on Foothill Road in <br />terms of sidewalk construction.
