Commissioner Michelotti asked if the applicant is going to install extra soundproofing. Mr. Mesick said the walls between the subject site and the restaurant include soundproof"mg; the other side does not. Commissioner Hovingh asked Mr. Mesick to respond to the letters of application and whether smoking would be allowed. Mr. Mesick felt that the concerns of those persons would be taken into the utmost consideration. In addition, the general billiard area will not allow smoking; however, one suite will accommodate smoking. Commissioner Horan briefly discussed the use of beer in the establishment with Mr. Mesick. Condition 4 addresses the use of alcoholic beverages. Robert Cordtz, 262 W. Angela, wholeheartedly supported the project and stated that he just wishes it were downtown. THE PUBLIC HEARING WAS CLOSED. A motion was made by Commissioner Hovingh, seconded by Commissioner Michelotti making the Conditional Use Permit findings as listed in the staff report; and approving Case UP-91-46 subject to the conditions listed in Exhibit B. Zoning for the property is PUD (planned Unit Development) Medium Density Residential) District. Commissioner McGuirk abstained from the discussion; Commissioner Wright stepped in. Mr. Iserson presented the staff report recommending approval of Tract 6160 subject to the conditions of the staff report.
