<br />NEW BUSINESS - PUBLIC HEARINGS <br /> <br />UP-91-46. Hacienda Billiards <br />Application of Harold Mesick for a conditional use permit to operate a billiard parlor, <br />install up to three video games, and sell beer after 10:00 p.m. (bar), at an existing <br />building located in The Crossroads Retail/Office Center at 4555 Hopyard Road. Zoning <br />for the property is PUD (planned Unit Development) - I1C-O (Industrial/Commercial- <br />Office) District. <br /> <br />Mr. Iserson presented the staff report recommending approval of Case UP-91-46, subject to <br />the conditions of the staff report. He called attention to two new conditions stating that the <br />applicant shall install glass windows and/or doors into the private suites, and that no one <br />under the age of 18 years shall be permitted to remain after midnight. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Harold Mesick represented the application. He stated that he has lived in Pleasanton for six <br />years, and presently works for the City of Pleasanton. He said he and his wife have three <br />boys so are very concerned about building a service suitable for families. He said he is <br />willing to adhere to any conditions the Commission might impose. All but the private rooms <br />will be non-smoking; there will be no gambling; children under the age of 16 will be allowed <br />with their parents' consent; children will not be allowed before 3 p.m. so as to discourage <br />cutting school. They would like for parents to come in fIrst and give permission for their <br />children to come. Mr. Mesick stated that his father is a retired marshall and will operate the <br />facility during the day; Mr. Mesick and his wife will operate it at night. He said that if <br />approved, the business could be open by the end of October. <br /> <br />Commissioner Michelotti asked the applicant to elaborate on his plans for the private rooms. <br />Mr. Mesick felt the private rooms would fill more of a business need for someone needing to <br />entertain a client, etc. The suites are more expensive. He added that billiards are an <br />excellent winter activity and felt this would give the City an added entertainment. <br /> <br />In response to Commissioner McGuirk's question, Mr. Mesick replied that transparent glass <br />will be installed in the windows and/or doors to permit surveillance. This is covered in the <br />new Condition 8 as presented tonight. <br /> <br />Commissioner McGuirk further questioned the applicant as to whether it was a first come, <br />first served type of process. Mr. Mesick said it is a first come, fIrst served situation; a per <br />hour fee of $10 is charged; there could be a waiting list at times, hence the availability of <br />some video games. Emeryville has had a waiting list at times of over an hour, but have <br />experienced no problem with it.
