<br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Horan, Hovingh, McGuirk, Michelotti, and Chairman Mahem <br />None <br /> <br />None <br />None <br /> <br />Resolution No. PC-91-48 was entered and adopted approving Case UP-91-30 as motioned. <br /> <br />Chairman Mahern asked Mr. Mitchum to try and solve the glass breakage problem. <br /> <br />UP-91-3S. Sherin Gahrahmat <br />Application for a conditional use permit to stockpile approximately 100,000 cubic yards <br />of dirt for future use on a vacant site located at 2900 Martin Avenue. Zoning for the <br />property is PUD (Planned Unit Development) - LDR (Low Density Residential) District. <br /> <br />Mr. Swift presented the staff report (noting that the Planning Commission had received an <br />addendum stating the applicant had requested approval to stockpile an additional 50,000 cubic <br />yards of dirt fill on the subject site) recommending approval of Case UP-91-35 subject to the <br />revised conditions of the addendum staff report which addressed hydroseeding and irrigation <br />of the stockpile. He also called attention to a letter of opposition from Mr. and Mrs. Tom <br />Coler that was handed out tonight. <br /> <br />Chairman Mahern asked if the dirt is just dumped on a pile or smoothed out. Mr. Swift <br />replied that it is a six foot high pile of dirt but the intention is to smooth it out with <br />equipment. This mound will then be hydroseeded to keep dust to a minimum. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Larry Bartleson, Civil Engineer of Livermore, represented the application. He stated he has <br />read the staff report and concurs with the five conditions, but wished to clarify Condition 3 <br />in that they intend to hydroseed the dirt stockpile, not put groundcover as the report <br />indicates. <br /> <br />Chairman Mahern noted there are six conditions, not five. Mr. Swift presented the revised <br />conditions to the applicant and noted that Condition 3 has been revised to allow for <br />hydroseeding, not groundcover. <br /> <br />Mr. Bartleson explained that approximately 11 acres of the 97 acres would have dirt <br />deposited; this would be smoothed to a height of about six feet and hydroseeded. No <br />irrigation system will be on site, but watering will be done to get the grass established. <br /> <br />Commissioner Horan stressed that if dust becomes a problem or should the grass die, he <br />would expect the applicant to do something about solving the problem.
