The project is located within <br />the Golden Eagle- Phase 2 subdivision. zoning for the property <br />is PUD (Planned Unit Development) - Low Density Residential <br />District. <br /> <br />Application continued indefinitely. <br /> <br />AP-91-3. Michael Peel and Darlene Crane <br />Appeal of zoning Administrator denial of Case V-91-9, an <br />application for a variance from the Municipal Code to allow the <br />constuction of a new home that would encroach within the required <br />~ front and side yard setbacks, to be located at 952 Gray Fox <br />Circle (Tract 5188, Lot 12). zoning for the property is PUD <br />(Planned Unit Development) - Low Density Residential District. <br /> <br />Mr. Swift presented the staff report recommending denial of Case <br />AP-91-3. <br /> <br />commissioner Wright asked for clarification regarding the houses <br />next door to the site being into the 25 ft. setback. Mr. Swift <br />explained the Code allows chimneys to project four feet into a <br />front yard setback; there is a chimney on the house that projects <br />into the front yard. The Code also allows some bay window <br />features to project into a front yard setback as long as they are <br />not over a certain size and take up a certain percentage of <br />space. There is also a bay window projecting into the front yard <br />setback. The Code also allows uncovered porches to project into <br />the front yard setback. <br /> <br />Chairman Mahern asked staff the approximate distance between <br />other houses on Gray Fox Circle. Mr. Swift was not sure of <br />that figure at the present time.
