<br />Case UP-91-25 subject to the five conditions listed in the staff <br />report. <br /> <br />ROLL CALL VOTE <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />commissioners Hovingh, McGuirk, Michelotti, Wright <br />(for Horan) and Chairman Mahern <br />None <br />commissioner Horan <br />None <br /> <br />AYES: <br /> <br />Resolution No. PC-91-43 was entered and adopted approving Case <br />UP-91-25 as motioned. <br /> <br />UP-91-27. Pleasanton Sauare Partners <br />Application for a conditional use permit to allow a fast food <br />restaurant, Taco Bell, located at 6010 Johnson Drive. zoning for <br />the property is PUD (Planned Unit Development) _ Industrial, <br />Commercial, and Offices District. <br /> <br />Mr. Swift presented the staff report recommending approval of <br />Case UP-91-27 subject to the conditions of the staff report. He <br />called attention to an added condition in regard to the hours of <br />operation of Taco Bell. He also called attention to Condition 7 <br />in regard to litter, noting that Taco Bell is responsible for <br />policeing their area. <br /> <br />~ <br /> <br />commissioner McGuirk asked how far an area Taco Bell would have <br />to police for litter. Mr. Swift said the intent is for Taco Bell <br />to pick up their litter and general litter that blows from their <br />area to the adjacent areas. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Tom Terrill of Reynolds and Brown, 1,200 Concord Avenue, suite <br />200, Concord, CA, represented the application and stated that he <br />has no problems with the conditions as set forth in the staff <br />report or with the condition regarding litter piCk-Up. He said <br />in about a month Taco Bell will be submitting an application for <br />a monument sign and hoped they would be considered. <br /> <br />THE PUBLIC HEARING WAS CLOSED. <br /> <br />A motion was made by Commissioner Michelotti, seconded by <br />Commissioner Wright making the conditional use permit findings <br />and approving Case UP-91-27 subject to the conditions listed in <br />Exhibit B, along with the revised conditions as noted by staff. <br /> <br />Minutes Planning COmmission <br />JUDe 26, 1991 <br /> <br />Page 4 <br /> <br />- <br /> <br />- <br />
