<br />supporting Mr. Toomey, but the first time things get out of line, they will go to the property <br />manager and lodge a complaint. <br /> <br />Commissioner Michelotti reminded Mr. Sweeney that the staff report backs up his position <br />and as a conditional use permit this application can always be returned to the Commission. <br /> <br />Simone Bouveia, owner of Nuvo Salon next door to the restaurant, hoped Mr. Toomey's <br />business is successful as he has been there since 1978 and Mr. Toomey will be the sixth <br />business at that site. His chief concern is what happens outside the business in the parking <br />lot; he is concerned that people will be hanging around in the lot and he has concern for his <br />clients and his employees. He is also concerned about vandalism in the back parking as this <br />does happen from time to time, mostly to the vehicles. He is especially concerned about the <br />winter months when it gets dark early; as the game room back door is rather hidden; he <br />expressed concern that this could escalate any problem. He wanted some kind of recourse <br />should problems occur and wanted to know who to call. He was also concerned about noise <br />as this would disturb his clients. <br /> <br />Commissioner Horan questioned Mr. Bouveia as to what kind of businesses had previously <br />been located there. Mr. Bouveia recalled that a pet store and a health food store had been <br />there in the past. Commissioner Horan did not feel the game room would create any more <br />noise than barking dogs. Mr. Bouveia said the pet store had special walls that muffled the <br />sound. The Commission indicated that something of this nature could be installed at the <br />game room. <br /> <br />Virgil Gass, 2678 San Leander Way, said he and his wife operate Clover Creek which is <br />near the proposed project. He noted that the staff and Commission have worked hard to <br />create a good image for downtown Pleasanton and he would not like that to be harmed. He <br />felt the restaurant was a good business to have downtown, but said he would favor denial of <br />the game portion of the business. He wished to state for the record that if the application is <br />passed as requested and people begin to loiter in front of the store, and they end up having <br />public safety problems, he would like for Mr. Toomey to state for the record that he would <br />be willing to remove the games. <br /> <br />Chairman Mahern pointed out that tenants always have the option and protection of <br />complaining about the situation as the application is operating under a conditional use permit <br />and this permit can be revoked. <br /> <br />Mr. Gass expressed concern that even if complaints were made that it would take years <br />before anything was done. The Commission assured him that was not the case. <br />Commissioner Michelotti felt that the applicant should have a chance to start a business and <br />see if it will work.
