,- Commissioner Michelotti asked Mr. Clanker what he felt the solution might be. Mr.
Clanker said that at times there are 10-13 cabs on site; he felt the applicant simply
needed to get rid of some of the cabs not in use so the cabs parked outside could
park in the building.

Commissioner McGuirk questioned Mr. Clanker further on the number of parking
spaces allowed.

Stan Rathbone, 325 Ray Street, pointed out that the request that the applicant
keep the building doors shut when working on the vehicles may be burdensome to
the applicant in very hot weather. He felt he should be allowed to keep them
open. In addition, he felt the radio should have enough power in order to be
effective for the applicant's range of operations.

~

Michael Deering, 1043 Serpentine Lane, Suite D, said he is on the Board of
Directors for the complex. He said he really has no problem with the manner in
which the applicant is parking his vehicles, except that he is abusing the laws
when the cabs park in fire lanes and handicapped zones, or in someone else's
parking spaces. He also expressed concern about the appearance of the building
and felt that the adjoining businesses suffer when one tenant does not do his part.
He felt that the building could be better utilized for parking of outside vehicles. He
said he does not care how many spaces the applicant uses on the street, he just
does not want him parking illegally and that the vehicles outside should be used on
a daily basis, not sitting unused for more than 48 hours. He added that the color
of the cabs is no problem to him.

The Commission further discussed with Mr. Deering the manner of parking and the
number of working cabs owned by the applicant.

Mr. Ghorbani returned to the podium. He responded to Mr. Clanker's concern that
he uses six parking spaces while everyone else uses four. He said that when he
bought the unit, Valley Business Park had only one other tenant. The seller was so
interested in motivating the applicant to buy, along with the fact that .his square
footage is higher, that he gave him six parking spaces which is noted in the
CC&R's. In addition, he said he does not have 10-13 cabs, but only 8-9 cabs. In
regard to Mr. Rathbone's comment about the radio, he said his main power supply
comes from Mt. Diablo and he has experienced no problems with transmissions.

Mr. Ghorbani added that he is willing to work with his drivers as to any parking in
the handicapped zones or fire lanes. Commissioner Hovingh reminded the
applicant that even if the drivers park for only a very brief period of time in those
lanes that he could receive a $50 fine. He said he also needs to consider the
handicapped who might wish to park there.

~

MINUTES PLANNING COMMISSION APRIL 10, 1991 Page 7

.. . I .
