<br />,- Ms. Watts presented the staff report recommending approval of Tract 6400 <br />subject to the conditions of the staff report. <br /> <br />Commissioner Hovingh expressed concern about the long term development in that <br />area, in particular on the Gandolfo property. He asked what the access would be <br />to that property should it ever be developed. Mr. Higdon responded that the <br />Gandolfo property has less than six lots. It is anticipated they would be served off <br />of a 20-28 ft. private street which is being allowed for. <br /> <br />Chairman Mahern discussed the water tank with Ms. Watts and Mr. Higdon. In <br />response to her question, Mr. Higdon agreed that if the developer could not <br />negotiate with the property owner where the water tank must be located, that the <br />right of eminent domain would prevail. Ms. Watts added that the route for the <br />water tank, and whether it would be above or below ground, would be decided at <br />the tentative map stage. <br /> <br />Chairman Mahern asked staff what the rationale was in allowing houses over the <br />670 ft. elevation on this project. Mr. Swift said as he recalled that occurred at the <br />time the General Plan was adopted about five ye,ars ago. The issue came up in <br />regard to the Presley and Panganiban properties. He explained that these ridges <br />are considered to be different than the Pleasanton ridge and are more like foothills <br />to the main ridge. Therefore, the 670 ft. elevation may not be applicable in this <br />r- particular area, and Council exempted the Presley and Panganiban properties from <br />this restriction. <br /> <br />Further discussion ensued in regard to elevation of pads and visibility of the homes <br />from Highway 680. Ms. Watts indicated they would not break the viewshed, but <br />could be visible from a great distance. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Dick Striegel, 1850 Mt. Diablo Blvd., Walnut Creek, represented the application. <br />He stated he is the Director of Planning for Presley Homes and has been working <br />very hard on this project. He thanked staff for the large amount of time they have <br />put on this application and stated he felt the report is very complete. He briefly <br />discussed grading issues and indicated that a balance could be achieved without <br />any off-haul being done. He has reviewed the staff report carefully and had some <br />minor concerns with several of the conditions: <br /> <br />Condition 12 - This is in reference to the Dublin Canyon Road improvements. The <br />PUD condition expressed that Presley would contribute or reimburse another <br />developer for any improvements done on their project. That has now been <br />changed so that Presley would construct all the improvements and then get <br />reimbursement from the other developers.
