<br />the statements in certain documents should not be left up to the <br />Planning Director to have to mitigate, and cited an instance of a <br />tree being on a landslide area. <br /> <br />Ms. Dennis felt the city could be liable for lawsuits should an <br />EIR not be completed for this project and that staff may be put <br />in a difficult position in the future. <br /> <br />Chairman Mahern stated she also appreciated Ms. Dennis' comments <br />and concerns about the lack of an EIR; however, she felt that the <br />purpose of an EIR was to raise issues that are going to have an <br />environmental impact, and whether a project can gO forward if <br />there are mitigations. She continued that in most EIR's they do <br />not spell out each detail which must be taken care of, but that <br />much is left to be done by some other decision-making body. She <br />could not see that what has been done so far is so very different <br />than what an EIR would accomplish and felt that all the issues <br />can be addressed with a Negative Declaration. <br /> <br />commissioner Horan further discussed the Committee's letter and <br />concerns with Ms. Dennis. <br /> <br />~ <br /> <br />David Glenn, 5650 Foothill Road, said he supports the project; <br />however, he had some concerns with the road going past the Moller <br />property to his home and how this would affect his address and <br />mailbox. He stated he has expressed his concerns in a letter to <br />staff. Mr. Swift said he is willing to meet with Mr. Glenn, but <br />felt his concerns can be easily worked out and do not need to be <br />addressed at this stage. <br /> <br />Mr. Glenn stated that he is in favor of the open space being <br />dedicated as open space so that his grandchildren might also <br />enjoy it. <br /> <br />Gary Schwaegerle, 189 W. Angela, stated that he supports the <br />project. He is very familiar with the property, and noted that <br />in response to Ms. Dennis' comment about seeing grading on the <br />property, the grading was done at least 25 years ago. <br /> <br />Mr. MacDonald returned to the podium. <br /> <br />commissioner Michelotti asked Mr. MacDonald if there is any <br />dollar amount allocated for fire trucks and emergency vehicles. <br />Mr. MacDonald indicated this is not included in the staff report; <br />apparently some figure has been calculated, but not set. He said <br />they are in accordance with paying their pro rata share and know <br />that figure is less than $2,000 per unit. <br /> <br />Chairman Mahern asked Mr. MacDonald how the applicant would feel <br />about the possibility of putting the open space into a permanent <br />open space easement or dedicated space.
