<br />~ <br /> <br />~ <br /> <br />~ <br /> <br />regarding the City of Pleasanton versus Alameda County and the <br />Mary King p~an. The brief states that projects cannot be <br />conditioned on the dedication of conservation easements. The <br />reason for that is because unfair things can happen. He <br />indicated that the applicant would probably be willing to work <br />with the City on this matter, and in fact, felt that a trail <br />system could be successfully tied into proposed trails on <br />adjacent properties. <br /> <br />Chairman Mahern reiterated her concern that the projects come <br />before the Commission like this one are very commendable and <br />praiseworthy because of the open space available, but the <br />Commission simply wants to guarantee that the open space remains <br />open space. Further discussion ensued between Chairman Mahern and <br />Mr. MacDonald. <br /> <br />Commissioner Horan noted that a heretofore public trail on <br />Kottinger Ranch has recently been closed to public access and <br />questioned the reason for that action. Mr. MacDonald said this <br />was because of liability reasons. The same kind of liability <br />exists if the proposed project has a public trail system, <br />especially if a spring on the property is made deeper for the <br />habitat of the tiger salamander. <br /> <br />Commissioner Hovingh expressed concern about clean-up of <br />contaminated ground water. Mr. MacDonald assured him that this <br />issue would be properly mitigated. <br /> <br />Commissioner McGuirk noted that the project is supposed to <br />generate a large amount of money for Lydiksen and Foothill High <br />Schools. He asked whether in the light of an anticipated <br />shortfall in school district funds for the coming year, if it <br />would be guaranteed that funds from the project would actually go <br />to those particular schools. Mr. MacDonald was not aware of the <br />district shortfall, but the part that was guaranteed to go to <br />Lydiksen School from the Laguna Oaks project will indeed go to <br />that school; he felt it would be the same for the Moller project. <br /> <br />Commissioner McGuirk expressed concern that RV's, boats and motor <br />homes might be visible from the front of the homes. Mr. <br />MacDonald said he thought the city Ordinance would take care of <br />that issue; in addition, it can be stated in the CC&R's. <br /> <br />Commissioner Wright wished to make certain that the issue of <br />contaminated ground water will be properly mitigated.
