<br />commissioner Hovingh asked Mr. MacDonald if they plan to join E <br />Court and A Street at the top. Mr. MacDona1d said that is <br />correct and he had no problem with that being a public street. <br /> <br />commissioner McGuirk discussed with Mr. MacDonald Condition 43 <br />and whether the 5 ft. sidewalk would be on only one side of the <br />street. Mr. MacDonald felt many of these detai1s would again be <br />addressed at the tentative map stage. <br /> <br />In response to Commissioner McGuirk's question, Mr. MacDonald <br />said that on a 29 ft. wide street, parking would be on only one <br />side of the street. <br /> <br />Frank Berlogar, 5587 Sunol Boulevard, addressed ground water <br />contamination issues on the site. He stated they have found the <br />ground water is contaminated by some paint and some diesel <br />spillage of about 2,500 cubic yards or 5 gallons of contaminant. <br />In response to Commissioner Michelotti's question, Mr. Berlogar <br />said this would be mitigated by hauling off heavily contaminated <br />soil. Further discussion ensued regarding the issue of ground <br />water contamination. Mr. Berlogar stressed that the amount of <br />contamination present on the site is not life-threatening or <br />hazardous. <br /> <br />Commissioner McGuirk asked whether any seepage from the <br />contaminated ground water could have gone under Foothill Road. <br />Mr. Berlogar indicated that is possible, and they do intend to <br />take ground borings to ascertain whether this has happened. <br /> <br />Becky Dennis, 838 Gray Fox circle, represented Preserve Area <br />Ridgelands Committee and said her comments have been presented to <br />the Planning Department in the form of a letter. She stated <br />their concerns about the fact the city has come to the conclusion <br />that it is not necessary to prepare an Environmental Impact <br />Report for the project, but that a Negative Declaration is <br />adequate to prove that with proposed mitigation measures the <br />project will not have a significant adverse affect on the <br />environment. Ms. Dennis felt the tentative map might address <br />some of the other issues of concern, but that it still does not <br />negate the need for an EIR. She said the Committee feels that <br />accepting the Negative Declaration without an EIR shows that <br />mitigation measures are completed. She felt the City still does <br />not have sufficient information and that an EIR is necessary in <br />order to protect the City from possible future litigation. <br /> <br />commissioner Hovingh stated that he appreciated the Committee and <br />Ms. Dennis' research on the matter. <br /> <br />In response to a comment by Ms. Dennis, Commissioner Horan stated <br />he disagreed with her in regard to an inference that if an <br />application does not go before the Council that it does not go <br />before the public.
