~-

be run, noting that Foothill High School band will be playing.
They are intend~ng to pay the band for playing so it will also be
a fundraiser for the school. They are intending to rope off the
parking spaces in front of the individual stores to give people
room to move around and for the band to play in without being in
danger of being hit by an auto. They intend to use A frames to
anchor the ropes. They will ask the Amador High School art
department to paint arrows on the A-frames for directional
movement. It is anticipated the spotlight will be on Friday
night.

Commissioner Michelotti suggested that it would be appropriate
for the organizers of the event to contact the neighbors in
regard to the event and the use of the spotlight and the balloon.
Ms. Boehm indicated they would do so; she said the balloon is
intended to be placed on top of the Shell station and will be
there for only 24 hours or less beginning Friday night.

commissioner Horan stressed that he does not wish for the balloon
to be advertising the Shell station.

Commissioner Hovingh questioned Ms. Boehm as to why she is
working on this project in the light of being a realtor and not a
retail store. Ms. Boehm stated that she has recently moved to
that location and wants people to know where her office is.

Commissioner Michelotti had no problem with the band, the balloon
or the spotlight; however, she did not want it to be a moving
spotlight or a disturbance to the neighbors.

Chairman Mahern thought the balloon on the Shell Station was
enough without having the spotlight. She also felt the band
might disturb the neighbors. She felt that this shopping center
must be very sensitive to the neighbors in the light of past
actions.

Commissioner Horan and McGuirk were also concerned about the
spotlight disturbing the neighbors.

Mr. Thomas assured the Commission it would not be a moving
spotlight and that it would be turned off at 10 pm.

THE PUBLIC HEARING WAS CLOSED.

A motion was made by Commissioner Hovingh, seconded by
Commissioner Horan recommending approval of Case PUD-80-15-5D-3M,
modifying Condition 9 of PUD-80-15-5D subject to the conditions
of the staff report, with the following modification:

o That the spotlight shall be turned off at 10 pm.

KIRUTBS PLANNING COMMISSION FEBRUARY 27, 1991 Page 16

11

.
