~ UP-91-2. Chevvs Mexican Restaurant Application ror a oonditional use permit to sell alcoholic beverages after 10:00pm (bar) at a restaurant located at 5877 OWens Drive. Zoning for the property is PUD (Planned Unit Development) - Industrial, commercial, and Offices District. Mr. swift presented the staff report recommending approval of Case UP-91-2 subject to the conditions of the staff report. THE PUBLIC HEARING WAS OPENED. Jeff Johnson, pier 35, San Francisco, represented the application. He stated he has read the staff report and only wished to clarify if 12 am means midnight. In addition, he said they classify themselves as a restaurant rather than a bar. Mr. Swift told Mr. Johnson that 12 am does mean midnight. THE PUBLIC HEARING WAS CLOSED. A motion was made by Commissioner Hovingh, seconded by Commissioner McGuirk making the conditional use findings as listed in the staff report; and approving Case UP-91-2 subject to the conditions of the staff report. Mr. Swift presented the staff report recommending approval of UP- 91-1 subject to the conditions of the staff report. He called attention to a letter from the Balch Investment Group in support of the application. THE PUBLIC HEARING WAS OPENED. ~ Robert Lewis, 5003 Woodthrush, represented the application as business manager and board member of the Pleasanton Playhouse.
