Chairman Wright inquired how Hacienda Daycare operates a first and second grade school
program if school use is not an allowable use within Hacienda. Mr. Swift advised that
within the PUD there are public institutional daycare and private school designations under
which Hacienda Daycare and other private schools operate.

In response to Commissioner Barker regarding the General Plan Review Committee's
schedule, Mr. Swift believes their recommendations will be presented to the City Council by
the end of January or the first of February.

Peter McDonald, 400 Main Street, spoke on behalf of the Pleasanton School District. He
noted this is a proforma legal process, and the purchase of the land is not contingent on a
change to the General Plan. He advised the School District has the option of exempting
itself from the City's zoning ordinances. They would like to work within the City's
guidelines, however, the location of schools is viewed as solely a School District decision.
Mr. McDonald noted that the School District agrees with the staff report and
recommendations.

Commissioner Barker inquired if the School District had public hearings on this school
location. Mr. McDonald advised that the meeting where the contract was accepted was a
public meeting and anyone could have voiced their opinion. He stated that the business
neighbors were all noticed of the possible land purchase, and no one raised any objections.
Mr. McDonald advised that the community as a whole has not been notified.

Mr. McDonald noted that a new school site location has been ongoing for some time and
several locations were reviewed.

A motion was made by Cornrni"Sioner Hovingh, seconded by Commissioner Barker,
rmding the site's prospective use as a middle school is not presently consistent with the
City's General Plan.

ROLL CALL VOTE

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Dove, Hovingh, Lutz, Barker, and Chairman Wright
None
Commissioner McGuirk
None

Resolution No. PC-94-70 was entered rmding Lot 16A's (Hacienda Business Park)
prospective use as a middle school is not presently consistent with the City's General
Plan.

Chairman Wright feels the Planning Commission should adhere to staffs recommendation to
initiate a process to bring the site into conformity with the General Plan. He wants the
process to include a public hearing, the Planning Commission providing input regarding

Planning Commission Minutes

Page 5

December 14, 1994
