<br />meet the current sideyard setback, though staff notes the joint property line with the adjacent <br />property sharply drops away from the house at a steep pitch, therefore staff believes there is <br />little chance a house will be built close to the Berlogar house. Final design review approval <br />will be made administratively. Staff clarified that the Planning Commission is granting <br />approval for expanding the house, and the design review will go through the regular <br />administrative process. Mr. Swift advised the setback will not be allowed to be changed. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Frank Berlogar, 2200 Vineyard Avenue, represented his application, and stated he is in <br />agreement with the conditions of approval with the exception of Condition 6. He would like <br />a modification to Condition 6, proposing to upgrade the entire structure to a one hour rating. <br />He believes the associated costs of installing a sprinkler system for the house's great room <br />would be better spent in upgrading the entire structure to a one hour rating. Mr. Berlogar <br />clarified he would use 5/8" sheet rock throughout the entire structure as well as a clay or tile <br />roof material. <br /> <br />Commissioner McGuirk inquired if staff considered the option of adding additional sheet <br />rock or the one hour option; Mr. Swift was not clear what options were explored by staff. <br /> <br />Harvey Kameny, 2832 Gray Fox Ct., shares the same property line with Mr. Berlogar. He <br />spoke in favor of this application, and advised the addition to the Berlogar home will not <br />affect the view from his house. He encouraged the Planning Commission to approve this <br />conditional use permit. <br /> <br />In response to Commissioner Hovingh, Mr. Swift advised that the Fire Station No.4 for the <br />Ruby Hill area will be somewhere near Vineyard and Bernal to be built at some unspecified <br />time. That being the case, the subject lot will probably fall within the five minute response <br />time. Currently, the plan calls for a life-saving emergency station to be built within the <br />Ruby Hill project, with fire fighting response coming from a Livermore fire station. Mr. <br />Swift suggested the condition be modified to specify that the building's fire safety <br />requirements be constructed consistent with the City's General Plan policies. <br /> <br />Mr. Berlogar is willing to accept the suggestion of Mr. Swift. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Chairman Wright proposed Condition 6 be modified to be more open-ended to be worked out <br />with the Fire Department, Building Department, and the applicant to construct the entire <br />structure to be a one hour rating.
