<br />Mr. Pavan stated that the proposal has been reviewed and approved by members of the <br />Department of Fish and Game. Furthermore, substantial noticing has been sent to adjoining <br />property owners, and only two individuals came forward to review the proposed plans. Both <br />owners indicated their acceptance of the proposal. <br /> <br />A benefit of the proposed change is the removal of fill previously approved in more <br />environmentally sensitive swale areas behind Kottinger Ranch and on the Lin property. For <br />all of the above reasons, staff feels a minor modification and a conditional use permit are <br />appropriate and are the recommended actions. <br /> <br />In response to Commissioner Wright's inquiry regarding the hours of operation, Mr. Pavan <br />stated that the hours as listed in Condition 12 will be enforced. <br /> <br />Chairman McGuirk clarified with Mr. Pavan that the application is not changing the source <br />of the grading material, only where the graded dirt will be deposited. <br /> <br />In response to Commissioner Dove, Mr. Pavan stated that Condition 18 specifies no grading <br />will occur between October 15 and April 15 unless erosion measures are in place. <br /> <br />Commissioner Barker inquired whose responsibility would it be to maintain the new fill <br />areas. Staff stated that once the project is accepted by the City Engineer, if erosion, <br />drainage, etc. problems occur within the first year, the Westbrook Housing Group is <br />responsible the repair. After that time, the Kottinger Ranch Homeowners Association would <br />be responsible for the fill areas located in Kottinger Ranch, and the fill area on the Lin <br />property would be the responsibility of the Lins. Mr. Jost stated his belief that the fill slopes <br />will be better than the natural slopes because the planted grasses will control erosion. <br /> <br />Commissioner Barker inquired if the Homeowners Association had been notified. Staff <br />stated that the Homeowners Association had authorized the work to proceed in the common <br />open area of Kottinger Ranch. <br /> <br />In response to Commissioner Lutz, staff stated that because the Bonde construction site road <br />was with a width of 15' to 18' and a steeper topography proved to be acceptable, they <br />believe a 20' wide road with a lesser slope will be appropriate for the Kottinger Ranch <br />project. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Mr. Scott Shaull, 1302 Benedict Court, represented the application and the Westbrook <br />Housing Group.
