<br />Responding to Commissioner Barker, Mr. Beougher advised the one year maintenance period <br />begins when the City Engineer accepts the project. Mr. Shaull stated the remainder of the <br />project development would take another 1-1/2 years to be completed, indicating that if any <br />erosion problems occurred, they would be on-site and available to repair the situation. <br /> <br />PUBLIC HEARING WAS CWSED <br /> <br />Commissioner Wright commented on Condition 7 regarding the $5,000 per tree bond and a <br />five tree limit. He stated areas C and D have several trees and he does not want the trees <br />destroyed and the developer liable for only five trees. Commissioner Wright would like to <br />leave the $5,000 per tree stipulation in and remove the five tree maximum. <br /> <br />PUBLIC HEARING WAS RE-OPENED <br /> <br />Mr. Shaull stated that they have posted a $2 million dollar bond with the City, and would <br />like that bond to cover any damaged trees. Mr. Beougher advised that the $2 million is to <br />cover the public improvements. Mr. Shaull stated he would suggest the bond company <br />attach a rider for $25,000 maximum. Mr. Beougher stated that developers are not likely to <br />obligate themselves to pay up to $25,000 for destroying trees, and he does not feel it will be <br />a problem at Kottinger Ranch. <br /> <br />PUBLIC HEARING WAS CWSED <br /> <br />Commissioner Barker inquired if Westbrook's responsibility for erosion control could be <br />increased to two years. Mr. Beougher advised the City has found the one year period to be <br />sufficient. Commissioner Barker stated her desire to see it lengthened to two years unless <br />the Homeowners Association is willing to assume the liability after one year. Mr. Jost stated <br />that dry years allow ground water to seep through cracks, therefore, the land fill areas will <br />be adequately tested during a drought period. Commissioner Wright does not want the time <br />period increased to two years. <br /> <br />Mr. Beougher advised Commissioner Barker that an additional condition could be included <br />requiring a two-year responsibility for Westbrook, the second year would not require a bond <br />being in place. Mr. Shaull stated that Westbrook would oppose that condition, but would <br />defer to the Commission's decision. <br /> <br />In response to Chairman McGuirk, Mr. Beougher stated that nine months after the City <br />accepts the project, all the City departments inspect the site and develop a punch list of <br />improvements needed to be performed by the Westbrook Housing Group. <br /> <br />Commissioner Dove believes adding an additional year to this project would be setting a <br />precedence for future projects.
