Utilitv Vault ComDany <br />Application for a conditional use permit and design review approval to continue <br />operation of a contractor's storage yard located on an approximately 4.3 acre site at the <br />northwest corner of the intersection of Boulder Street and Valley Avenue (3500-3590 <br />Valley Avenue). Zoning for the property is I-G-40,OOO (General Industrial) District. <br /> <br />Continued to 2/9/94. <br /> <br />M. RZ-94-01. Citv of PJpllSanton <br />Application to add Chapter 17.48 (relating to the Right to Farm) to Title 17 (planning <br />and Related Matters) of the Pleasanton Municipal Code. <br /> <br />Mr. Iserson presented the application recommending the Commission recommend approval to <br />the City Council of the proposed zoning text amendment. <br /> <br />Commissioner Wright referred to Paragraph 17.48.040 regarding the 24 hour period. Mr. <br />Beougher stated the intent was to imply the disturbance was not limited to the time between <br />dawn to dusk. Commissioner Wright wanted clarification of the time frame outlined <br />17.48.060 (C). Mr. Beougher advised that the only undetermined time frame was how long <br />the Alameda County Agricultural Advisory Committee takes to mediate. He suggested that a <br />time limit of 60 days may want to be included. The intent is to provide mediation, and if <br />resolution is not possible, the agricultural use will predominate. <br /> <br />Commissioner Hovingh inquired about the minimum of five acre parcels. Mr. Beougher <br />stated that areas of less than five acres are grandfathered in until someone changes their use. <br />Commissioner Hovingh inquired if someone can change from one agricultural use to another <br />agricultural use. Mr. Beougher stated that if the uses are accepted, (not conditional uses), <br />they can change without coming to the City for approval. <br /> <br />Chairman McGuirk inquired if this ordinance could be used by the City Council to prevent a <br />developer from developing adjacent property to agricultural use property because of the <br />potential for future disputes between land uses.
