<br />~ <br /> <br />Commissioner Wright commented there is a discrepancy of whether the lights would be <br />turned off at 11 p.m. or if they would be on all night. Mr. McNichols stated that their <br />classes are over at 10 p.m. and the lights could be turned off soon thereafter. <br /> <br />Commissioner Hovingh inquired if the University of Phoenix occupied the total floor area of <br />the building. Mr. McNichols stated that due to the present vacancies, they would be located <br />in two buildings, occupying about one-half of the total area of each building. Commissioner <br />Hovingh then inquired if they would, in the future, relocate all of their offices in one <br />building. Mr. McNichols stated that it is not cost efficient for the owner to relocate tenants <br />once he has invested in tenant improvements. <br />Commissioner Mahern stated that the staff report indicates the University of Phoenix's <br />intention of leasing space is contingent upon getting wall-mounted signage. She asked if they <br />would go forward with the lease if the Commission approved halo wall mounted signage. <br />Mr. McNichols stated they would have to explore the visibility, size, etc. of the approved <br />signage. <br /> <br />Mr. McNichols stated he had briefly read the staff report, and is aware that the Commission <br />doesn't want to change the policy for all Pleasanton office parks, but he further explained <br />that the University of Phoenix is more of a retail institution because they attract people to <br />them by visibility and making the public aware that they are in the area. <br /> <br />Dominic Dutra, Dutra Realty, 160 Grau Drive, Fremont, has a 28,000 sq. ft. building at the <br />corner of Chabot and Stonerldge Drives in Hacienda. He has read the staff report and feels <br />this application also relates to his business. Mr. Dutra proposed a fifth option to the <br />Commission in conjunction with the four options outlined in the staff report. He proposed a <br />mix of both halo and internally illuminated signage around the perimeter of the office park <br />for complexes adjacent to retail centers where internally illuminated signage is allowed. He <br />advised there is a significant difference in the visibility of internally illuminated versus halo <br />illuminated signage. <br /> <br />In response to Commissioner Michelotti, Mr. Dutra believes his business is more a <br />retail/service business than it is an office complex, the difference being their hours of <br />operation. They do not close and go home at 5 p.m.; they sometimes have appointments <br />very late in the evening. <br /> <br />PUBLIC HEARING WAS CWSED. <br /> <br />In response to Commissioner Michelotti's question to staff of why Contempo Realty has <br />internally illuminated signage, Mr. Swift stated that it is located in a complex where one <br />building is retail and the other is an office building. The sign program is the same for both <br />buildings and allows internally illuminated signs. <br /> <br />Commissioner Wright asked staff for clarification of which tenant of the Pleasanton Park <br />buildings would have the illuminated signage. Mr. Swift stated that a particular area was <br />identified in the application where the sign would go. Only one tenant of the building would <br />have signage, and the landlord would choose who would get the signage. It is simply a <br />matter of negotiation between landlord and tenant.
