With this in place, staff does not feel there will be y problem with respect <br />to water and infrastructure. <br /> <br /> <br />Commissioner Mahern noted that she had spoken with Chris Owens d Mark Sweeney. <br /> <br />Chairman Hovingh noted for the record that he has spoken privately .th Chris Owens. He <br />asked Mr. Swift if the City-wide mitigation fee would be levied on n w development. Mr. <br />Swift stated that it is proposed to be levied on all new development, oth commercial and <br />residential. In further response to Chairman Hovingh's question reg ding fees to low <br />income housing developers, Mr. Swift replied that it has been the Cit 's policy to waive all <br />fees in regard to the development of low income housing. <br /> <br />Chairman Hovingh asked staff if an applicant comes in with a change in land use for any of <br />the 24 lots, whether the City could re-examine the traffic impact. M. Swift affirmed the <br />City would be able to do that. <br /> <br />Chairman Hovingh referred to a staff comment that the City would n t do a traffic study for <br />each development that would subsequently come into Hacienda Busin ss Park. He further <br />questioned whether all the restriping is completed in Hacienda Busine s Park. Mr. Swift <br />explained that all the striping is not yet complete; however, Council as authorized necessary <br />~ modifications to be made with extra NPID funds that are still availab <br /> <br />Chairman Hovingh expressed some concern that traffic counts might ot be done as in the <br />past and asked staff what would trigger another traffic study or furth r monitoring. Mr. <br />Swift wished to clarify that traffic monitoring in Hacienda Business P k will continue to be <br />done. All the intersections are part of the City's automatic count m hanism and traffic <br />levels can be found out immediately by calling traffic engineering. <br /> <br /> <br />Commissioner McGuirk noted that he met with Mark Sweeney and C ris Owens. <br /> <br />THE PUBLIC HEARING WAS OPENED. <br /> <br />Chris Owens, 4309 Hacienda Drive, represented the application. H stated that he felt Mr. <br />Swift had summarized the situation very accurately and concurred wi h the Conditions of <br />. Approval. He felt that the Development Agreement could be treated asically the same as <br />the one recently done for Stoneridge Drive. He went on to say that rudential has fulfilled <br />all their obligations during the last ten years that they have worked w th the City. He stated <br />the NPID has paid more than their fair share of traffic mitigations. e noted that the <br />Development Agreement is basically an update of the original agree nt with the City; he <br />felt that Prudential has been a good citizen of the community.
