<br />c Mr. Owens noted that the situation has raised some concerns from th Val Vista shopping <br />center owner and tenants in that they are afraid that the Lucky groce store might not be <br />able to remain open if the land use for Site 14a took place. It was hi opinion that the <br />Conditions of Approval would protect Val Vista shopping center. H said that Prudential is <br />also concerned with being a good neighbor and would not wish to h the area. If their <br />request for a land use change is granted, they would work with Val ista tenants to keep any <br />possible impact low andlor to find a new anchor tenant should Lucky store leave. <br /> <br />Commissioner Finch stated he has spoken with Chris Owens about a and use change for Site <br />14a and the Conditions of Approval. He expressed concern that the chor tenant in Val <br />Vista would not be able to survive should a land use change allow an ther market to come in <br />nearby. He would not like to observe an exchange from one anchor nant with another <br />anchor tenant at a different location. However, with the Conditions f Approval as they are <br />stated, he felt the conditions would protect the existing anchor tenant 'n Val Vista. <br /> <br />Commissioner Mahern spoke with Mr. Owens about the length of th Development <br />Agreement. Mr. Owens stated that the Development Agreement is sl ted to be up in the <br />year 2020. He realized that seemed to be a long time; however, so of the agreements <br />with the City in regard to the streets do not end until 2020. <br /> <br />Commissioner Mahern noted that in speaking previously with Mr. 0 ens they had referred <br />to the Wells Fargo agreement. She wished to remind him that she h d voted against that. <br /> <br />~ <br /> <br />Chairman Hovingh asked if the City has taken possession of all the s eels in Hacienda <br />Business Park, but that Hacienda must still maintain the streets to Cit standards. Mr. Swift <br />noted the City has taken possession. Hacienda pays a fixed fee, but' is not until 2020 that <br />they do so for street maintenance. Hacienda is responsible for land pe maintenance within <br />those streets until 2020 and possibly beyond that. <br /> <br />Commissioner McGuirk asked Mr. Owens what kinds of things Prod ntial would and could <br />do to keep Val Vista from becoming a ghost town. Mr. Owens said rudential could <br />actively go out and look for other uses to take over the Val Vista spa e should Lucky stores <br />move out. He noted that Mark Sweeney is a broker and has been pr -active for a number of <br />years in this business. <br /> <br />COMMENTS IN OPPOSITION OF APPLICATION <br />Paul Ebright, 5416 Blackbird Drive, spoke in opposition to the appli ation. He stated that <br />ten years ago he had vigorously opposed development in Hacienda B siness Park. He felt <br />that because of his and his neighbors' involvement and opposition, th t they had received <br />some concessions. One of the concessions or conditions was on traf c mitigation measures. <br />He did not think it was right at this point to tell the citizens that wha was approved ten years <br />ago can now be changed. He also objected to page 9, number 4 of e Development <br />Agreement in regard to water mitigation.
