Martha Grist, part owner of the property, briefly commented she ho would look fairly at the situation and ignore what she considered to b from several of the speakers. the Commission personal comments Further discussion ensued between Commissioner Mahern and Mr. S ift as to the location of the stream. Commissioner Wright said he felt the steps taken by Mr. Joel were f 'r and adequate to supply Ms. Sorenson and the wildlife habitat with sufficient water. e further felt staffs conditions are adequate and that these conditions were generated by hat was seen and given to the Fish and Game Department. He favored going with staff's rec mmendation for approval. Commissioner Mahern noted staff agreed the stream was not mention in PUD-89-13, and felt that it was not mentioned because it had not been contemplated re might be some kind of diversion of that stream, and that the stream was always intended stay exactly the way it was. She felt that had the possibility of water diversion been rai at that time, there would have been more study regarding the issue. She felt at this poi t the matter needs to be more closely studied and recommended Option 2, which states that P -89-13 did not contemplate the proposed use, would be appropriate. She would eith r deny the application or send it back for a modification to the PUD. ~ Commissioner McGuirk stated he would prefer to go along with the s f report's recommendation and supported Option 1. He felt action taken by the applicant was not being detrimental to the spring or to the source of water for either the wildl fe or Ms. Sorenson. Chairman Hovingh also felt the process taken by Mr. Joel, staff and e Fish and Game Department was adequate. He did have some trouble with the estima ed diversion rate, but felt this could all be worked out, possibly with a flow meter device. e further questioned Mr. Swift as to whether the Fish and Game Department is aware of e use of the "Y" connector. Mr. Swift explained that the Fish and Game Department i aware of it. Chairman Hovingh addressed Condition 4 and suggested that the wor ing could be modified to state "any substantial change, etc." Commissioner Mahern reiterated her concerns and felt that the water iversion method had not been carefully thought out, and that it appeared to be somewhat 0 a makeshift situation.
