H expressed concern as
to how much "one-half" actually is. Ms. Sorenson did not think that was very much. Mr.
Swift stated from information he had that staff felt it was sufficient keep enough water in
that portion of the creek to preserve the riparian nature of the creek. That may not be
enough for Ms. Sorenson's well; however, staff does not have any in ormation as to how
water gets to that well; how it reacts in drought situations, etc. He It that Mr. Joel and
Ms. Sorenson needed to work that out.

Becky Dennis, 838 Gray Fox Circle, stated her interest in the appli tion has to do with her
continued interest as a member of Preserve the Ridgelands. She felt s. Sorenson was an
unfortunate party to the situation and that Mr. Joel is receiving water at her expense. She
also felt the Planning Department and Council were not fully aware f Mr. Joel's intentions
with the water diversion. She stated she could understand Mr. Joel's aversion to using City
water with the impending cost related to the Moller development; ho ever, she indicated that
at the public hearing for the Moller PUD, he did not request any mi gation of a disruption
of his future water service.

Ms. Dennis concluded her remarks by urging the Commission to den the referral and to
urge the applicant to use City water. This would safely protect the ater for wildlife and for
the Sorensons. She was further opposed to any new uses to the sprin , and felt with the cost
of water rising, that the City would be possibly setting a precedent d making more
problems for themselves.

Mr. Joel returned to the podium. He felt several speakers had stray away from the land
use issues tonight; however, he wished to reiterate that he plans to al ays provide water for
the wildlife in the area. He further wished to remind Ms. Dennis an Mr. Glenn that a lot
line adjustment is a private transaction between two property owners. He did agree there
was some misunderstanding in the situation; however, he stated that e submitted a plan to
the Planning Department and also the Fish and Game Department wh ch was approved. He
noted he is not proposing a new use for the water. He further stated at getting City water
to his place would cost in the area of $50,000-$75,000. He conclud that he and Ms.
Sorenson feel they can settle the situation agreeably and urged the Co mission go along with
the staff report.

THE PUBLIC HEARING WAS CWSED.

Planning Commission Minutes
July 8, 1992

Page 17
