<br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Mahern, McGuirk, Wright, and Ch . <br />None <br />Commissioner Michelotti <br />None <br /> <br />Resolution No. PC-92-61 was entered and adopted recommending <br />of a Sidewalk Improvement District as motioned. <br /> <br />Referral from the Zonin~ Administrator <br />Determination by the Planning Commission as to the conformlt <br />and storage proposed by Mannie Joel/Martha Greist with the 0 <br />the A-M Homes/Garms Ranch PUD-89-13 (4440 Foothill Road). <br /> <br />Hovingh <br /> <br />Council the exploration <br /> <br />of the water diversion <br />n space designation in <br /> <br /> <br />Mr. Swift presented the staff report recommending the Commissio determine that the <br />proposed use is consistent with the designated open space use appr ved for this area for Case <br />PUD-89-13 . <br /> <br />Chairman Hovingh noted for the record that he had met with Mann e Joel last evening. He <br />pointed out to the public the issue under discussion is a land use is e, not a water rights <br />issue, which would be a civil matter. He called attention to a lette presented to the <br />Commission this evening which staff had received today from Lyn Sorenson. He noted the <br />concerns of Ms. Sorenson had to do with water rights which is a c' il issue, which had also <br />been addressed by Mr. Swift in his presentation. <br /> <br />Commissioner Mahern stated for the record she was pleased that C airman Hovingh gave the <br />Commission time to read the letter which they had just received to ight. She asked staff <br />whether at the time of the lot line adjustment request, if it was bro ght to his attention that it <br />would aid a water diversion. Mr. Swift replied there was an issue hether or not the spring <br />around the property would be used by Mr. Joel. That was obvious y one of the reasons why <br />the lot line was drawn as it was. It was known that the spring was going to be on the <br />property to be used by Mr. Joel from the Garms' property, and th at some time he would <br />probably attempt to utilize that spring in conjunction with his agric ltural use of the property. <br />At that time it was made clear any use of the property that was zo ed PUD Open Space <br />would have to conform to that zoning designation. This is the sub equent action to that <br />situation. <br /> <br />Commissioner Mahern asked Mr. Swift what happens to the creek uring a drought, such as <br />the last several years.
