She further noted at this point she felt the Planning Departm nt should work with the <br />landlord, not the tenant. <br /> <br />Ms. Vaughn returned to the podium. <br /> <br />Commissioner Mahern stated she understands the City's viewpoint' wanting a sidewalk in <br />the mall areas, but also had a problem with the City coming back n w and requiring that a <br />sidewalk be installed. She asked Ms. Vaughn if the property owne would be willing to give <br />a right-of-way. <br /> <br />Ms. Vaughn replied that she did not think the property owner woul be willing to pay for the <br />installation of a sidewalk at this time. The property owner feels th t the City does not have <br />the right to require him to give up his property for a right-of-way, d then also pay for the <br />improvements. She further noted that even if Ms. Wong finds she s to leave the premises <br />because she cannot afford to pay for the sidewalk installation that s e would still have to pay <br />for the lease until in expires in 1995. <br /> <br /> <br />Mr. Higdon suggested that the Commission recommend to Council ey set up a Sidewalk <br />Improvement District as it is desired to get people out of their cars or short trips. <br /> <br />- <br /> <br />Ms. Vaughn commented that she manages another complex in Wal ut Creek where a similar <br />situation existed with no sidewalk. She noted CalTrans is going to emove the landscape <br />strip, pay for the sidewalk, and pay for installation of the planting f trees, etc., without the <br />property owners having to pay for anything. <br /> <br />THE PUBLIC HEARING WAS CWSED. <br /> <br />Discussion ensued regarding the installation of a Sidewalk Improve ent District. Mr. Swift <br />suggested the Commission recommend that Council study the matte . <br /> <br />Commissioner Wright felt Condition 7 should be deleted and that it definitely should not be <br />up to the tenant to have to convince the property owner to dedicate easement for a <br />sidewalk. He also felt a sidewalk was not necessary in this area, d that the area is not <br />even conducive to foot traffic. <br /> <br /> <br />e further felt the <br />ity.
