project would still be feasible at less units. He wished to state for the record that he felt
staff did a thorough staff report and that they made some very vall recommendations about
the need for a geological survey. He continued to say that as a ho e owner he wanted to
make sure the lots were spaced properly to maintain the rural atmo here.

Murt Van Dreser, 40 Castledown Road, Pleasanton, said he had y documented his
comments in December 1990, but wished to reaffirm that the Foo Road Overlay District
was a good plan which he hoped they would follow. He continued to say that he felt
portions of the project simply had too high a density.

Mr. Smith had no further comments.

THE PUBLIC HEARING WAS CLOSED.

Commissioner Michelotti questioned Mr. Swift about how the open space would be handled
and maintained. Mr. Swift stated that all of the property in this pI' ~ect is owned by
individual home owners and that the large area of open space is sh wn as part of the Currin
lot. Therefore, all the open space would be maintained by the indi . duals. He further
responded that there must be some type of fire control, and in esse ce, would be no different
than how the Deer Oaks subdivision open space is handled. Furth discussion ensued in
regard to potential landslide dangers and resulting liability.

A motion was made by Commissioner Hovingh, seconded by Com issioner Michelotti
recommending the adoption of a resolution certifying that the S is adequate and complete
in assessment of the project's impacts.

number of Heritage

Commissioner Michelotti further discussed the matter of limiting
trees that could be removed.

Chairman Mahern noted that she had just received the CEQA docu ent tonight, and felt they
could only act on the SEIR document.

Commissioner Horan discussed the plan with Mr. Swift. He noted that if the road were to
be moved further west, that the third row of houses would have to moved. He expressed
concern that this might put these houses in the slide area.

In response to Commissioner Wright's question, Mr. Swift stated at the applicant agrees
with all the conditions except for the condition which would bring e lots down to 51.

The Commission agreed to simply address the SEIR tonight, give e applicant some input,
and continue the rest to February 20, 1992.

Minutes Planning Commission
February 12, 1992

Page 12
