The Trail will be retained for purposes of serving the EBRPD property (Shadow Cliff Regional <br />Recreation Area, just north of the Vineyard Avenue Trail) and to provide access to the subject <br />site. The EBRPD intends to install a gate at some point in the future and have stated that it will <br />not interfere with the access to this property. The applicant will be required to record a deed <br />disclosing the potential for a gate to be constructed by the EBRPD at some point along the Vine- <br />yard Avenue Trail. <br /> <br />Miscellaneous <br /> <br />Fireplaces <br />The Specific Plan also has restrictions on fireplace construction. The proposed plans indicate <br />several fireplaces to be constructed. The Specific Plan limits the units to only be EPA (United <br />States Environmental Protection Agency) approved fireplaces and wood-burning stoves. Staff <br />has conditioned the approval to ensure compliance with this requirement. <br /> <br />Sewer and Water connections <br />The existing site contains a septic tank and leach fields, the Specific Plan requires that all new <br />development be connected to the City's sanitary sewer services. The existing residence cur- <br />rently uses a private well. The Specific Plan also requires connection to the City's water service <br />with all new development. As conditioned, the applicant would be required to connect to the <br />City's sewer and water services and that all existing septic facilities be appropriately discon- <br />nected and/or removed. The well will remain for irrigation purposes only. <br /> <br />PUBLIC COMMENT <br /> <br />Notices of the Planning Commission's public hearing were sent to the residents within a 1,000- <br />foot radius of the subject property. Staff has not received any comments pertaining to the pro- <br />posed development as of the time the staff report was written. <br /> <br />PUD DEVELOPMENT PLAN FINDINGS <br /> <br />The Pleasanton Municipal Code sets forth the purposes of the Planned Unit Development (PUD) <br />District and the considerations to be addressed in reviewing a PUD development plan proposal. <br />The Planning Commission must find that the proposed PUD development plan conforms to the <br />purposes of the PUD District, as listed below, before making their recommendation to the City <br />Council. <br /> <br /> 1. Whether the proposed development is in the best interest of the public health, <br /> safety, and general welfare. <br /> <br />The proposed development, as conditioned, meets all applicable City standards concerning pub- <br />lic health, safety, and welfare, e.g. vehicle access, geologic hazards (not within a special studies <br />zone), and flood hazards. The proposed development is designed to be compatible with the adja- <br />cent land uses, as well as the General Plan and Vineyard Avenue Corridor Specific Plan desig- <br /> <br /> Item 6. b., PUD-43 Page 8 of 25 April 7, 2005 <br /> <br /> <br />
