developer's expense, shall be required to determine the value of the damage or loss and <br /> the resultant sum paid to the City's Urban Forestry Fund. <br /> <br /> 26. Landscaping installation time requirements: <br /> a. Prior to building permit final~ all front and side yard landscaping shall be <br /> installed. <br /> <br /> b. Within 90 days of occupancy, all rear yard landscaping shall be installed. <br /> <br />Fire Conditions <br /> <br /> 27. The project developer shall meet all requirements of the Pleasanton Fire Code (Pleasanton <br /> Municipal Code, Chapter 20.24). <br /> <br /> 28. The project developer shall keep the site free of fire hazards from the start of lumber <br /> construction until the final inspection. <br /> <br /> 29. Prior to any construction framing, the project developer shall provide adequate fire <br /> protection facilities, including, but not limited to a water supply and water flow in <br /> conformance to the City's Fire Department Standards, able to suppress a major fire. <br /> <br /> 30. The project developer shall meet all requirements of the Pleasanton Fire Code (Pleasanton <br /> Municipal Code, Chapter 20.24). <br /> <br />Disclosure/Deed Restriction/Clause Conditions <br /> <br /> 31. The recorded deed of sale for all lots covered by this approval shall include the following: <br /> a. A clause which states that the property is in an area subject to noise, dust, and <br /> vibration levels from gravel harvesting and processing and that the City of <br /> Pleasanton is not liable for possible damages due to such impacts. <br /> <br /> b. A disclosure statement shall be provided to prospective purchasers and tenants by <br /> lot owners, developers, and future successors in interest providing full disclosure of <br /> the potential for: <br /> I. Future mining operations within the Specific Plan Area. <br /> <br /> II. Noise, odor, and illumination associated with the operation of the asphalt <br /> batch plant on the RMC/Lonestar property easterly of the lots covered by this <br /> development plan. <br /> <br /> c.
