Any second-story element of the reside~ce on Lot 12 shall <br />be located at the southeast corner of Ithe home and shall <br />be set back from the first-sto y building wall <br />sUfficiently to give architectur 1 interest and <br />articulation to that building elevat on. In addition, <br />the north side yard property line sha 1 be increased to <br />35 feet, the second-story shall be limited to 1,000 <br />square feet, and the total square foo age of the future <br />home shall not exceed 5,000 square ffet (excluding 450 <br />square feet of garage area). , <br /> <br />1. The Foothill Road setback shall be 120 feet and the north <br />side yard setback shall be 25 feet. <br /> <br />5. <br /> <br />An updated set of the design guidelines incorporating the <br />conditions contained herein shall accompa y any final parcel <br />map application. These details shall be submitt d for review and <br />approval in conjunction with any house pl n application. <br /> <br />The developer shall establish a recorded m1' ntenance agreement <br />for the project. The agreement shall designate <br />responsibilities for maintaining all commo private utilities, <br />private streets, and landscape area betwej the frontage road <br />and Foothill Road. The City shall be gra ted the rights and <br />remedies of the association, but not he obligation, to <br />enforce the maintenance obligations. The ity Attorney shall <br />review and approve the proposed maintenanc agreement prior to <br />the recordation of a Parcel Map for tlhe project. The <br />developer shall coordinate this agreement!with the developer <br />of the property to the south to astablish one (1) <br />comprehensive maintenance agreement. <br /> <br />6. <br /> <br />.
