published by the Superintendent of Streets of said Town of Pleasanton; <br />and <br /> <br /> WHEREAS said Superintendent of Streets did then, to wit, on the <br />20th day of December, 1940, cause to be conspicuously posted along the <br />line of said contemplated work or improvement, at not more than three <br />hundred (300) feet in distance apart, but not less than three (3) in <br />all, notices of the passage of said Resolution No. 1735; that said <br />notices were in the form and set forth all the matters and things re- <br />quired by law to be therein set forth; and <br /> <br /> WHEREAS said Superintendent of Streets caused a notice similar <br />in substance to be duly published for four successive insertions in <br />"The Pleasanton Times," a weekly newspaper published and circulated in <br />the Town of Pleasanton; and <br /> <br /> ~i~,~EREAS more than ten (10) days have elapsed since the first <br />publication of said notice and more than ten (10) days have elapsed <br />since the expiration of the time of the publication of said notice as <br />aforesaid; and <br /> <br /> WHEREAS no objections to said proposed work or improvement or <br />to the extent of the district of land to be affected or benefited by <br />said work or improvement have been filed with or delivered to the Clerk <br />of the Council of the Town of Pleasanton, or made to or received by said <br />Council of the Town of Pleasanton; and <br /> <br /> WHEREAS the public interest and convenience required that all <br />of the hereinbefore described portion of Rose Avenue be closed up and <br />abandoned; and <br /> <br /> WPEEREAS said proposed work is for closing up and abandoning, and <br />it appears that no assessment is necessary; and <br /> <br /> WEREAS it appears from a report and title insurance policy <br />furnished by the Oakland Title insurance and Guaranty Company that the <br />County of Alameda, a body corporate and politic, and a political sub- <br />division of the State of California, is the owner of all the lands <br />adjacent to the portion of Rose Avenue hereby ordered closed up and <br />abandoned; and <br /> <br /> - 2 - <br /> <br /> <br />
