INTERSECTION <br /> OF SAID ROSE XV~ENUE ~ITH PLEASAi~0N ~VENUE; AUTHORIZING AND <br /> DIRECTING TE EXECUTION, ACKNOW~G~iEIqT ~ND DELIVERY OF A <br /> DEED TO THE ABUTTING 0~VNER, AND FINDING ~ND DETERjDINING THAT <br /> EQUITY RECLUIRES THE C01WEYiNCE TO SAID :~BUTTING 0WI¢~R OF TI~E <br /> PORTION OF ~HE STREET ORDERED CLOSED UP AND 'XBANDONED. <br /> <br />The Council of the Town of Pleasanton do ordain as follows: <br />SECTION 1. '~VEREAS the Council of the Town of Pleasanton did <br />on the 16th day of December, 1940, pass its Resolution of Intention <br />No. 1735 to order the closing up and abandoning of the following <br />described piece, part or portion of Rose Avenue in the Town of Pleasan- <br />ton, which is particularly described as follows, to-wit: <br /> <br /> C0~.'~fMENCING at the point of intersection of a line drawn <br />parallel to the Southwesterly line of Rose Avenue and distant North- <br />easterly 12.00 feet, measured at right angles thereto, with a line <br />drawn parallel to the Northerly boundary line of that certain 100 <br />Acre, piece or parcel of land described in that certain Decree <br />Terminating Joint Tenancy in the Matter of the Petition of Charles <br />R. Kranz, for Termination of Joint Tenancy with Jessie F. Pope, de- <br />ceased, dated February 7, 1940 and recorded February 8, 1940 in Liber <br />3832 of Official Records, at page 419, thereof, Records of Ale~eda <br />County, California, and distant Southwesterly 24.00 feet, measured at <br />right angles tt~ereto, and running thence along said line drawn arallel <br />to the Northerly boundary line of said 100 .~kcre tract, North 89~ 39, <br />30' West, 16.11 feet to said Southwesterly line of Rose Avenue (the <br />bearing of the Northerly boundary line of said 100 Acre tract being <br />taken as North 89° 39' 30" West for the purpose of making this de- <br />scription) thence along said Southwesterly line of Rose Avenue South <br />41° 30' East 1932.14 feet to an intersection thereof with the North- <br />westerly line of Pleasanton Avenue; thence leaving said line of Rose <br />Avenue North 28° 00' 15" West, 51.42 feet to a point on the aforesaid <br />line drawn parallel to the Southwesterly line of Rose Avenue and <br />distant Northeasterly 12.00 feet, measured atoright angles thereto; <br /> aw · <br />thence along last said line so dr n North 41 30' West, 1871 40 <br />feet to the point of commencement. <br /> <br /> BEING a portion of Rose Avenue in the Town of pleasanton. <br /> <br />and, <br /> <br /> WHEREAS said resolution described the work or improvement and <br />the land deemed necessary to be taken therefor, specified the exterior <br />boundaries of the district of land to be affected or benelAted by said <br />work or improvement and to be assessed to pay the damages, costs and <br />expenses thereof, and designated~The pleasanton Times," a weekly news- <br />paper pdblished and circulated in the said Town of pleasanton, as the <br />weekly newspaper in which the notice hereinafter referred to was to be <br /> <br /> - i - <br /> <br /> <br />
