<br />Resolution NO. PC-92-97 <br />Page 7 <br /> <br />An encroachment permit from Alameda county is required for the <br />section of Trenery Drive across the Lauer property. Prior to <br />submittal of the final map, the applicant shall contact the <br />property owners living on both sides of Trenery Drive regard- <br />ing their landscaping improvements located in the Trenery <br />Drive right-of-way. The applicant shall endeavor to obtain <br />all necessary right-of-way or easements for the improvements <br />on Trenery Drive from the adjacent property owners. The city <br />Engineer may modify the street section or change its location <br />as needed to preserve a significant landscape feature. <br /> <br />13. At the final map stage, the city shall work with the project <br />developer in determining the location of an interim emergency <br />access route -- across the Chu/Choi/Gahrahmat property or <br />Tract 6505 -- to stoneridge Drive. If the Chu/Choi/Gahrahmat <br />property is chosen, then this developer shall obtain an <br />easement from Chu/Choi/Gahrahmat. The access route shall be <br />constructed to the satisfaction of the City Engineer, Planning <br />Director, and Fire Marshall prior to occupancy of the first <br />lot covered by this subdivision. The City would be <br />responsible for maintenance of either access route with this <br />developer posting a cash bond with the City to cover the <br />maintenance costs calculated by the City Engineer for a 10- <br />year time period. <br /> <br />14. Tree nos. 8, 9, 19, 24, 33, 40, 41, 43, 50, 64, 68, 78, 86, <br />90, 94, 125, 135, 137, 139, 144, 147, 149, 165, 171, 179, and <br />186 as shown on the "Tree Survey Map" that is part of the <br />"Tree Survey for Walnut Glen Estates", dated February 13, <br />1992, by HortScience, Inc., on file with PUD 92-1 shall be <br />preserved. Maintenance of these trees shall be the <br />responsibility of the private lot owner. Mitigation measures <br />outlined in the tree report shall be implemented by the <br />project or private lot developer. All street grading and <br />construction activity shall be supervised by a licensed <br />landscape arborist on a periodic basis to be determined by the <br />Planning Director. After construction is completed, a final <br />status report shall be submitted to the Planning Director. <br /> <br />15. Ornamental orchard type trees, e.g., flowering plum, bradford <br />pear, etc., 15 gal. in size, shall be installed by the private <br />lot owner in the locations of the existing walnut trees to be <br />removed as recommended in the above-mentioned tree report. <br />The number of trees to be planted per lot along with the size <br />and type of trees shall be determined by the city Landscape <br />Architect and Planning Director prior to recordation of the <br />final map. The value of the new trees for each lot shall be <br />credited by the developer to the homeowner. Installation and <br />maintenance of these trees is the responsibility of the <br />homeowner. The CC&R's of the subject subdivision shall <br />include wording to the satisfaction of the City Attorney <br />covering the previously mentioned items. A plan showing the <br />size, type, and location of these trees on this subdivision <br />shall be submitted to the Planning Director for review and <br />approval prior to recordation of the final map. <br /> <br />.. <br /> <br />- <br />
