Resolution No. PC-92-95
Page 2

WHEREAS, the Planning Commission made the following findings for
a 38-1ot subdivision:

1. The proposed map is consistent with the General
Plan.

The 38-1ot tentative map, which locates homes off
the hillside and at least 50 feet away from the toe
of the hillside, is consistent with the acceptable
risk policy stated in the Public Safety Element of
the General Plan. The 37 proposed new homes, and
utilities and roads serving those homes are not
expected to be subjected to any seismic or
landslide induced hazards beyond that considered
"acceptable" by the General Plan. However, the
existing home, which is located within 50 feet of
the toe of the ancient landslide, may be subject to
a greater potential risk of damage than would be
considered "acceptable" by the General Plan.

The 38-1ot subdivision, with an overall density of
0.42 units per acre is consistent with the "Rural
Density Residential" and the "Low Density
Residential" land use designations of the site.
The proposed map generally is consistent overall
with the approved PUD plan and that part of the PUD
plan indicating lots on the flatter portion of the
site. The PUD was consistent with other General
Plan policies and programs when it was approved in
April 1992.

2. The site is physically suitable for this type of
development and density.

Two-thirds of the site is characterized by a
rolling and steep-sided hillside, while the eastern
one-third of the site is relatively flat. The 38-
lot development will occur on the flatter portion
of the site. The amount of grading proposed solely
for development of the site is limited. The street
system has been limited to that necessary only for
access into and through the site. An emergency
vehicle access road into the site from the
northeastern corner and a similar access which
traverses the open space portion of the site will
ensure proper emergency response for residents and
for the suppression of potential wildland fires.

Those portions of the site where potential lots
could be affected by active landslides would need
to be graded and re-engineered.
