<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-92-95 <br /> <br />RESOLUTION APPROVING VESTING TENTATIVE TRACT MAP 6563, THE <br />APPLICATION OF CURRIN CONSTRUCTION COMPANY <br /> <br />WHEREAS, Currin Construction Company has applied for a vesting <br />tentative map to allow the subdivision of an <br />approximately 91-acre site into 55 single-family lots and <br />one, approximately 41-acre open space lot located at 8015 <br />Foothill Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />Rural Density Residential/Low Density Residential <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of November 11, <br />1992, the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />city staff concerning this application; and <br /> <br />WHEREAS, the Planning commission could not make the tentative map <br />findings that the proposed 55-lot subdivision was <br />consistent with the City's General Plan because the <br />acceptable risk policy stated in the Public Safety <br />Element of the General Plan could not be met with 17 of <br />the 55 homes proposed for located on the hillside or <br />closer than 50 feet to the toe of the hillslope; and <br /> <br />WHEREAS, the Planning Commission could not make the tentative map <br />finding that the site is physically suitable for the 55- <br />lot subdivision because the hillside and areas within 50- <br />100 feet of the toe of the slope are susceptible to risk <br />of movement and instability due to seismic or landslide- <br />induced hazards, and therefore pose a potential risk of <br />damage to structures, utility lines and roads; and <br /> <br />WHEREAS, the Planning commission determined that the stability of <br />the ancient landslide does not meet the city's acceptable <br />risk policy of the General Plan Public Safety Element to <br />allow houses to be constructed on, or within 50-100 feet <br />of the toe of the slope and that a 38-1ot subdivision, <br />with homes located entirely on the flatter portion of the <br />site, was appropriate for the site; and <br /> <br />WHEREAS, <br /> <br />a final <br />prepared <br />PUD for <br />document <br /> <br />Supplemental Environmental Impact Report was <br />and certified by the city council prior to the <br />this site; therefore, no new environmental <br />accompanies this report; and <br /> <br />" <br /> <br />- <br />
