PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-92-95

RESOLUTION APPROVING VESTING TENTATIVE TRACT MAP 6563, THE
APPLICATION OF CURRIN CONSTRUCTION COMPANY

WHEREAS, Currin Construction Company has applied for a vesting
tentative map to allow the subdivision of an
approximately 91-acre site into 55 single-family lots and
one, approximately 41-acre open space lot located at 8015
Foothill Road; and

WHEREAS, zoning for the property is PUD (Planned Unit Development)
Rural Density Residential/Low Density Residential
District; and

WHEREAS, at their duly noticed public hearing of November 11,
1992, the Planning commission considered all public
testimony, relevant exhibits and recommendations of the
city staff concerning this application; and

WHEREAS, the Planning commission could not make the tentative map
findings that the proposed 55-lot subdivision was
consistent with the City's General Plan because the
acceptable risk policy stated in the Public Safety
Element of the General Plan could not be met with 17 of
the 55 homes proposed for located on the hillside or
closer than 50 feet to the toe of the hillslope; and

WHEREAS, the Planning Commission could not make the tentative map
finding that the site is physically suitable for the 55-
lot subdivision because the hillside and areas within 50-
100 feet of the toe of the slope are susceptible to risk
of movement and instability due to seismic or landslide-
induced hazards, and therefore pose a potential risk of
damage to structures, utility lines and roads; and

WHEREAS, the Planning commission determined that the stability of
the ancient landslide does not meet the city's acceptable
risk policy of the General Plan Public Safety Element to
allow houses to be constructed on, or within 50-100 feet
of the toe of the slope and that a 38-1ot subdivision,
with homes located entirely on the flatter portion of the
site, was appropriate for the site; and

WHEREAS,

a final
prepared
PUD for
document

Supplemental Environmental Impact Report was
and certified by the city council prior to the
this site; therefore, no new environmental
accompanies this report; and

"

-
